There is hereby created in the Borough of Baldwin a Vacancy Board, which Board shall consist of the Borough Council, exclusive of the Mayor, and one registered elector of the Borough who shall be appointed by the Borough Council at the Council's first meeting each calendar year or as soon thereafter as practical, and who shall act as Chairman of the Vacancy Board. Such registered elector appointed to the Board shall remain in office until the first meeting of the Council each calendar year or until his successor shall be duly appointed and qualified.
If any vacancy occurs in the office of Mayor, Council, Auditor, Controller, if elected, or Tax Collector by reason of death, resignation or removal from the Borough or, in the event that a vacancy occurs by reason of the failure of the person elected to take the required oath or to give bond as provided by law or ordinance or for any other reason whatsoever, and if the Council of the Borough of Baldwin refuses, fails or neglects or is unable, for any reason whatsoever, to fill any such vacancy within 30 days after the vacancy occurs, then such vacancy shall be filled within 15 additional days by the Vacancy Board created herein. Any person appointed by such Vacancy Board to fill any such vacancy shall hold such office to which such person is appointed, if the term thereof continues so long, until the first Monday in January after the first municipal election occurring more than 60 days after the vacancy occurs, at which election an eligible person shall be elected to the office for the remainder of the term.
If any such vacancy occurs in the offices referred to herein, and if such vacancy is not filled by the Vacancy Board within 15 days, then it shall be the duty of the Chairman of the Vacancy Board to petition the Court of Common Pleas of Allegheny County to fill the vacancy by the appointment of a registered elector of the Borough to hold such office, if the term continues so long, until the first Monday in January after the first municipal election occurring more than 60 days after the vacancy occurs, at which election an eligible person shall be elected to the office for the remainder of the term.
