This article shall be known and may be cited as the "Parking - Oversized Vehicles Ordinance."

This article is controlling as to the parking of trailers, oversized vehicles, and vehicles being used for living quarters, any other ordinances dealing with the subject of parking of such vehicles to the contrary notwithstanding.
The purpose of this article is to regulate and stop the use of the streets, public properties, and public parking areas for the parking of vehicles which, by reason of their size, bulk, or use as living quarters, unduly obstruct the vision of drivers and pedestrians, impede the flow of traffic on the narrow streets in Town, use an inordinately large amount of the limited on-street parking space, public property and public parking area in Town, contribute to overcrowding, detract from the general residential character of the Town, detract from property values, and constitute a hazard to the public health, welfare and safety.

When not inconsistent with the context, words used in the present tense include the future tense, words used in the plural number include the singular number, words used in the singular number include the plural number, and pronouns of any gender include all other genders. The word "shall" is always mandatory and not merely directory.

For the purposes of this article, the following terms, phrases and their derivatives shall have the meanings given herein:
A vehicle that:
To drive, operate, move, or be in actual physical control of a vehicle, including the exercise of control over or the steering of a vehicle being towed by a motor vehicle.
Any individual who drives a vehicle.
The entire width between the boundary lines of any way or thoroughfare of which any part is used by the public for vehicular travel, whether or not the way or thoroughfare has been dedicated to the public and accepted by any proper authority.
A motor vehicle, semitrailer, or trailer that is designed, constructed, and equipped as a permanent or temporary living or sleeping place and for use as a conveyance on highways, but does not qualify as a camping trailer or a travel trailer as these terms are defined in this article.
A vehicle that is self-propelled.
As used in reference to a vehicle, means a driver, as defined in this article.
A vehicle that either is over 21 feet two inches in length or is over six feet eight inches in width, or both.
As used in reference to a vehicle:
To halt a vehicle, whether or not it is occupied, other than temporarily:
Off-street areas preserved for public use and not specifically designated by an authorized sign for the parking of camping trailers, mobile homes, trailers, or travel trailers, as defined by this article.
A vehicle that:
A highway, as defined in this article.
That municipal corporation known as "The Town of St. Michaels."
A vehicle that:

A vehicle is under his control when the driver or operator of that vehicle causes that vehicle to be used in such a manner, or placed in such a position that with the passage of time, that a violation of this article occurs.
Any device in, on or by which any individual or property is or might be transported or towed on a highway.
A.
Parking of trailers and oversized vehicles. A person shall not cause or knowingly permit a camping trailer, mobile home, oversized vehicle, semitrailer, trailer, or travel trailer, owned by him or under his control to be parked and remain parked on any street within the corporate boundaries of the Town in substantially the same place on such a street for a period of 12 consecutive hours, or more.

Use of vehicles as living quarters. A person shall not cause or knowingly permit a vehicle owned by him or under his control to be used as temporary or permanent living quarters while parked on any street, public property, or public parking area in the Town.
Any sworn police officer of the Town shall be empowered to enforce the provisions of this article.
A.
Any person who shall violate any provision of this article shall be guilty of a municipal infraction, and subject to the procedures set forth in Chapter 33, Municipal Infractions.
B.
Each twelve-hour period that a violation continues shall constitute a separate offense.
D.
In addition to any fine or penalty set forth in this article, the Town may avail itself of any and all civil and equitable remedies, including injunctive relief, for the purpose of stopping any threatened or continuing violation of this article.
