A. 
Pursuant to the Local Budget Law, namely N.J.S.A. 40A:4-1 et seq., a Beach Utility is hereby created and established in the Borough of Bradley Beach, retroactive to January 1, 1991, for the purposes of collecting expenses, both direct and indirect, and revenue data with regard to the operation, maintenance and improvement of the beach, boardwalk and related facilities and shall be known and cited as "The Beach Utility of the Borough of Bradley Beach."
B. 
The Beach Utility budget shall set forth the anticipated revenues from the operation thereof which shall be set forth in a separate section of the budget.
C. 
The Beach Utility budget shall set forth the appropriations and shall include, as a minimum:
(1) 
Operations;
(2) 
Interest and debt retirement;
(3) 
Deferred charges and statutory expenditures.
D. 
The appropriate Borough officials and employees are directed, empowered and shall adopt accounting procedures consistent with this chapter and the aforesaid statutes in the creation and operation of the Beach Utility.
A. 
The membership of the Beach Utility shall consist of the Mayor and Borough Council members who shall supervise and control the Utility and shall have the power to identify, collect, budget, report and monitor all expenses and revenues in connection with the operation, maintenance and improvement of the beach, boardwalk and related facilities of the Beach Utility.
B. 
All appropriations in the Beach Utility budget shall be under the direction of the Mayor and Council as outlined in the regular municipal budget.
C. 
Nothing herein shall be construed to alter, modify or eliminate any of the responsibilities or powers of the Mayor and Borough Council with respect to the operation, maintenance, improvement and management of the departments, nor are any of the organizational reporting relationships intended to be altered, modified or amended.

The Borough of Bradley Beach hereby dedicates all revenues derived from the sale of beach badges to liquidate all sums borrowed in connection with the Beach Utility operation after payment of all expenses directly and indirectly chargeable to the operation, maintenance and support of the beach, boardwalk and related facilities. All income and expenses shall be kept separate and apart from the local municipal budget and shall be deposited in a separate Beach Utility Fund for the purposes identified herein as provided in N.J.S.A. 40A:4-33 et seq.
All matters with respect to the operation and conduct of the Beach Utility not determined by this chapter shall be determined by resolutions to be hereafter adopted.
