No person or persons, firm, association, club or corporation shall maintain, operate, conduct or pursue the business or occupation of keeping any public room or place wherein the games commonly known as "pool" or "billiards" are played without having first obtained a license therefor from the Mayor and Council of the Borough of Closter as hereinafter provided.
An application for a license shall be filed with the Borough Clerk on forms to be furnished by him or her, which forms shall require to be included the following information:
A. 
The name and address of the applicant and the name and address of the person or persons who will be in attendance at the premises and actually in charge thereof.
B. 
In the case of a partnership, it shall state the names and addresses of all partners.
C. 
In the case of a corporation, it shall state the names and addresses of the officers, directors and all stockholders presently holding stock and all who, for six (6) months prior to the making of said application, have been officers, directors or stockholders.
D. 
In the case of clubs or associations, it shall state the names and addresses of all officers.
E. 
Whether or not the person or persons named in the application have ever been convicted of a crime, and if so, the date and place of such conviction and the nature of the crime.
F. 
In the event that there should be any change from time to time as to the person or persons in attendance and actually in charge of the premises, written notice of such change shall be given to the borough by the applicant within five (5) days. Such notice shall include the name and address of any replacement or additional person or persons who will be in attendance and actually in charge of the premises.
G. 
The location of the premises to be licensed.
H. 
The number of pool tables and billiard tables located or to be located upon the premises to be licensed.
A. 
All licenses herein provided for shall be issued by the Borough Clerk only after a resolution of the Mayor and Council of the Borough of Closter shall have been adopted approving said application and only after the payment of the license fee herein provided for. All such licenses shall be valid from the first day of February of the year in which the license is issued until the 31st day of January next after the same is issued, unless sooner revoked. No license shall be issued to any applicant if such applicant or an officer, director or stockholder of such applicant or if the person in attendance at the premises and actually in charge thereof shall have been convicted of a crime or of contributing to the delinquency of a minor.
B. 
The person or persons in attendance at the premises and actually in charge thereof shall be at least eighteen (18) years of age and of good moral character. Failure to meet this requirement or to comply herewith shall be sufficient grounds for the denial of a license or the suspension or revocation of a license.

Such license shall bear the date of issue, the name of the licensee, the purpose for which issued and the location of the room or building wherein the licensee is authorized to carry on and conduct any such business. Such license may be transferred by the holder to any person or persons, firm, association or corporation; provided, however, that the transferee shall make application for such transfer to the Borough Clerk, such application to be in accordance with § 145-2 hereof, and provided further that such transfer is approved by resolution of the Mayor and Council of the Borough of Closter in accordance with the requirements set forth for original issue in § 145-3 hereof. Such license may be transferred by the holder to another location; provided, however, that the licensee shall make written application for such transfer, setting forth therein the proposed new location, and such transfer is approved by the Mayor and Council of the Borough of Closter.

For each pool table or billiard table located on the premises, the annual license fee shall be as set forth in Chapter A301, Fees and Deposits.

A. 
The Mayor and Council of the Borough of Closter may suspend or revoke the license of any licensee on any one (1) or more of the following grounds:
(1) 
Conviction of a violation of this chapter.
(2) 
If said license was procured by fraudulent conduct or false statement of a material fact or if a fact concerning the applicant was not disclosed at the time of filing the application, where such fact would have constituted just cause for refusing to issue said license.
(3) 
Permitting or suffering any activity upon the licensed premises which is or may be detrimental to the public health, safety, welfare or morals.
B. 
In all such cases, written notice of the charge or charges and the time and place of hearing thereon shall be served on the licensee, either in person or by certified or registered mail addressed to the licensed premises. No revocation or suspension shall occur unless the licensee shall have been afforded an opportunity to be heard in his or her defense.
C. 
In the event that any license is suspended or revoked, the licensee shall not be entitled to the return of the license fee or any portion thereof.
Any premises which shall be declared to be unsafe or unsuitable for use and occupancy by the public, by the written report of the Building Inspector or the Fire Inspector or the Sanitarian or the Health Officer, shall be deemed to be ineligible for a license. The Mayor and Council may suspend any license until such conditions are corrected, rectified or repaired.
The hours of operation of such pool or billiard room shall be between 9:00 a.m. and 2:00 a.m., Monday through Saturday. On Sunday, the hours of operation shall be from 2:00 p.m. to 2:00 a.m.
A. 
No person under the age of sixteen (16) years shall be admitted to or permitted to play pool or billiards in any licensed premises or to frequent, lounge or congregate in such room or place unless accompanied by his or her parent or guardian.
B. 
No person between the ages of sixteen (16) and eighteen (18) years shall be admitted to or permitted to play pool or billiards in any licensed premises or to frequent, lounge or congregate in such room or place after the hour of 10:00 p.m. unless accompanied by his or her parent or guardian.
In no event shall any dice games or cardplaying be permitted on premises licensed under this chapter, even if such dice games or cardplaying is for social purposes.
Any premises in which the games of pool or billiards are played, located on the street floor of any building, shall be so arranged and shall be so lighted that a full view of the interior may be had at all hours from the public thoroughfare or from adjacent rooms to which the public is admitted.
There shall be conspicuously posted and displayed in any premises licensed under this chapter:
A. 
The license issued pursuant to this chapter.
B. 
A copy of this chapter, which shall be supplied by the Borough Clerk.
C. 
Not less than one (1) sign giving notice that no person under the age of sixteen (16) years is permitted on the licensed premises unless accompanied by his or her parent or guardian.
D. 
Not less than one (1) sign giving notice that no person between the ages of sixteen (16) years and eighteen (18) years is permitted on the licensed premises after 10:00 p.m. unless accompanied by his or her parent or guardian.
Any person or persons, firm, association, club or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be subject to a penalty as set forth in Chapter 1, General Provisions, Article II, Violations and Penalties, of this Code.
