Unless another penalty is expressly provided by New Jersey statute or this chapter, every person convicted of a violation of this chapter, other than § 164-20.1, or any other supplement thereto, shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both. If a person is convicted of a violation of § 164-20.1, the guilty person shall be liable to a penalty of not less than $100 nor more than $250 or imprisonment for a term not exceeding 30 days or both. On a second or subsequent conviction under § 164-20.1, a guilty person shall be punished by a fine of not less than $100 nor more than $400 or imprisonment for a term not exceeding 60 days or both.
