WHEREAS, the Town of West New York has heretofore created the Town of West New York Municipal Utilities Authority ("WNYMUA"); and
WHEREAS, WNYMUA provides sewerage collection, treatment and disposal services within the territory of the Town of West New York; and
WHEREAS, the Town of West New York, WNYMUA and the Hoboken - Union City - Weehawken Sewerage Authority to be known in the future as the "North Hudson Sewerage Authority" (the "Authority") are in agreement that the service area of WNYMUA, comprising the territorial limits of the Town of West New York, should be a part of the district of the Authority; and
WHEREAS, this action is authorized pursuant to N.J.S.A. 40:14A-4(m); Now, therefore, the Board of Commissioners of the Town of West New York do ordain as follows:
The Town of West New York proposes that the whole of its territorial limits be included as part of the district of the Authority.
Two persons shall be appointed as members of the Authority by the Board of Commissioners.
It is hereby determined that, after the filing of a certified copy of this article and of a resolution of the Authority in accordance with N.J.S.A. 40:14A-4(m), the territorial limits of the Town of West New York shall be a part of the district of the Authority.
A certified copy of this article, together with a certified copy of a resolution of the Authority approving this article, shall be filed in the office of the Secretary of State, and from and after such filing, the territorial limits of the Town of West New York shall be part of the district of the Authority, and the Authority shall consist of the members thereof appointed as provided by N.J.S.A. 40:14A-4(m), including members appointed to the Authority by the City of Hoboken, the City of Union City, the Township of Weehawken and the Town of West New York.
This article shall become effective in the manner and at the time as prescribed by law, provided that it shall not be operative and until the outstanding bonds of WNYMUA have been paid or are deemed to be paid in accordance with the provisions of the General Bond Resolution of WNYMUA.[1]

Editor's Note: Ordinance No. 25/99, adopted 2-16-2000, provided for the dissolution of the West New York Municipal Utilities Authority (WNYMUA), originally created by Ord. No. 1383, adopted 3-19-1980. Ordinance No. 25/99 further provided that all real and personal property, facilities and contracts of the WNYMUA and all moneys and funds held by or for the WNYMUA shall be deemed transferred_to and become the property of the town and that the town shall assume all legal obligations to pay all existing and outstanding creditors and obligees of the WNYMUA. WHEREAS, the Hoboken - Union City - Weehawken Sewerage Authority, the City of Hoboken, the City of Union City and the Township of Weehawken (the "original participants") have heretofore entered into a service agreement with the Authority;
WHEREAS, the Authority shall be known as the "North Hudson Sewerage Authority;" and
WHEREAS, the original participants and the Town of West New York wish to enter into an amended service agreement with the Authority recognizing that the territory of the Town of West New York has been incorporated into the district of the Authority;
Now, therefore, the Board of Commissioners of the Town of West New York do ordain as follows:
The Town of West New York shall enter into an amended service agreement with the Authority in the form on file in the office of the Town Clerk. The service agreement shall be available for inspection by the public during the regular business hours of the Clerk.
Upon the taking effect of this service agreement authorized by this article, the service contract between the town and the Town of West New York Municipal Utilities Authority, dated as of August 15, 1986, shall be terminated and shall be of no further effect.
This article shall take effect in accordance with law but shall not be operative until the outstanding bonds of the Town of West New York Municipal Utilities Authority shall have been paid or payment shall have been provided for in accordance with the provisions of the General Bond Resolution of the Town of West New York Municipal Utilities Authority.
