WHEREAS, pursuant to its delegated police power under N.J.S.A. 40:48-2, the Town of West New York is empowered to make, amend, repeal and enforce such ordinances, regulations, rules and bylaws not contrary to the laws of this state or the United States as it may deem necessary and proper for the good government, order and protection of persons and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants; and
WHEREAS, situate within the Town of West New York are many multiple dwellings of 10 units or more which require on-premises management of their operation in order to assure the continued habitability of those premises for the benefit of all unit occupants; and
WHEREAS, many such multiple-family dwellings do not now provide for on-premises management of their operation with the result that conditions of habitability are allowed to deteriorate by virtue of the inattention of property owners and landlords to periodic maintenance of the units and repair of same; and
WHEREAS, the best means of assuring that such multiple-family dwellings continue to be regularly and properly maintained and repaired is to have an on-premises resident superintendent;
Now, therefore, be it ordained by the Board of Commissioners of the Town of West New York, County of Hudson, State of New Jersey, as follows:
A. 
Every multiple-family dwelling, as the same is defined in N.J.S.A. 55:13A-3(k), of 10 dwelling units or more shall have a superintendent who shall be a resident of said multiple dwelling and who shall be responsible for the care, maintenance and repair of the multiple dwelling and the dwelling units contained therein.
B. 
Every owner of a multiple dwelling of 10 units or more, as the term "owner" is defined in N.J.S.A. 55:13A-3(l), shall, within 60 days of the enactment of this article, provide a superintendent for said multiple dwelling, which superintendent shall be a resident of the multiple dwelling.
A. 
In the event that no dwelling unit is available for occupancy by a superintendent within 60 days of the date of this article, then the owner shall make available the next dwelling unit to become vacant for residence by said superintendent.
B. 
Until such time as a dwelling unit becomes available in the multiple dwelling, the owner shall, nevertheless, make provision for an on-premises superintendent who will be available for repair and maintenance of the multiple dwelling and dwelling units contained therein between the hours of 9:00 a.m. and 5:00 p.m. each workday and who shall be available to respond to emergencies at such other times.
Any person who violates this article shall be subject to the penalty provision in the Code of the Town of West New York.[1]
