No person shall manufacture, have, offer for
sale or sell any article of food or drink which is adulterated within
the meaning of an act of the Legislature of the State of New Jersey
entitled "An Act to Prevent the Adulteration of Food and Drugs," approved
March 25, 1881, and the supplement thereto, approved March 23, 1883, or
of any act or acts of said Legislature thereafter passed amendatory,
supplementary or additional thereto.
No milk or butter, nor any other food or drink
which has been exposed to the emanation or infection of any communicable
disease shall be brought into the Town of West New York or held or
offered for sale in said Town.
Every person being the owner, lessee or occupant
of any room, stall or place where any meat, fish or birds, fowl, fruit,
nuts or vegetables, designed or held for human food, shall be held,
stored, kept or offered for sale shall put and keep said room, stall
or place and its appurtenances in a cleanly and wholesome condition,
and every person having charge, or interested or engaged, whether
as principal or agent, in the care or sale of any meat, fish, birds,
fowl, fruit, nuts or vegetables, designed for human food, shall put
and preserve the same in a cleanly and wholesome condition, and shall
not allow the same, or any part thereof, to be poisoned, infected
or rendered unsafe or unwholesome for human food.
No cased, blown, plaited, raised, stuffed, putrid,
unhealthy or unwholesome meat, fish, birds or fowl shall be held,
bought, sold or offered for sale for human food, or held or kept in
any market, public or private, or in any public place in said Town.
Nor shall the carcass, meat or flesh of any cattle, sheep or swine
killed while in a diseased, overheated, feverish or exhausted condition,
nor any calf which shall be less than four weeks old, nor any pig
that shall be less than five weeks old nor any lamb that shall be
less than eight weeks old be brought into or kept, sold or offered
for sale for human food in the Town of West New York.
The body of any animal or part thereof, which
is to be used as human food, shall not be carted or carried through
the streets or avenues unless it be covered as to protect it from
dust and dirt, and no meat, poultry, game or fish shall be hung or
exposed for sale in any street, yard or alley or outside of any shop
or store, or in the open windows or doorways thereof in the Town of
West New York, nor shall the purity or wholesomeness thereof be in
anywise impaired.

If any cattle, meat, fish, birds, fowl, fruit,
nuts or vegetables are found by any inspector or other officer of
the Board of Commissioners in a condition which renders the same unsafe
or unwholesome for human food, it shall be the duty of said inspector
or officer to affix to said article or articles a label on which shall
be written or printed the words, "Condemned by direction of the Board
of Commissioners of the Town of West New York, New Jersey." When anything
included within the provisions of this section shall be found in numbers,
quantity or bulk, it shall only be necessary for said inspector or
officer to affix one such label on a conspicuous part of a box, tin,
basket, compartment or other place or thing containing the same, and
he shall forthwith report every such condemnation at the office of
the Board. No person or persons shall destroy, deface, conceal, interfere
with or remove any label affixed by any inspector or officer of this
Board, as aforesaid. It shall be the duty of the owner or person in
charge of any matter or substances that have been condemned to immediately
remove the same from any market, street or place and convey the same
to such place as may be designated by the inspector or officer; and
such articles shall not be sold or offered for sale or in any way
disposed of, and in case the owner or person in charge shall fail,
neglect or refuse to remove said articles within three hours after
having been notified to do so, the same may be removed by the inspector
or other officer of this Board, the owner or person in charge paying
all expenses thereof.
Whenever this Board shall have satisfactory
evidence that any well, the water of which is used for domestic purposes,
has become polluted or rendered unsafe for potable use, notice to
discontinue the use of said polluted water shall be sent to the owner,
agent, lessee or party in charge of said well, or to the corporation
supplying water for public use, and at the direction of this Board,
the owner, agent or lessee or party in charge of said well, or any
corporation selling water to the public, may be ordered in writing
to close or fill up said well or to remedy the impurity of such water
supply immediately. If the said order is not complied with within
the time therein specified, proceedings will be instituted to recover
the penalty.
Any bakery, confectionery, creamery, hotel or
restaurant, or any part thereof, shall be kept in a clean and sanitary
condition, subject to the approval of this Board.
Clothing worn by all operatives, employees,
clerks or other persons who handle the material or food intended for
distribution or sale shall be in a clean condition.
Persons employed in a bakeshop shall, while
working, not expose their body and shall wear sufficient clothing.
No animal, except a necessary cat, shall be
kept in a bakeshop, confectionery, creamery, hotel or restaurant.
No person suffering from or who has recently
suffered from or been in contact with any infectious disease shall
be permitted to enter or take part in the manufacture, sale or distribution
of any food supply, subject to the approval of the Board.
All factories should have separate suitable
dressing rooms for male and for female employees for their clothing
or garments, and a sufficient number of receptacles shall be provided
for expectorating, and they should be cleaned daily.
Whenever any basement or cellar or portion thereof
is used for any purpose of business, there shall be sufficient natural
light and ventilation, and accommodations such as a sanitary toilet
and sink. Any person failing or neglecting to comply with such notice,
within the time specified by this Board, shall forthwith close said
premises until such order from this Board shall be fully complied
with.

Fruits, flowers, plants, vegetables, meats and
other food products shall not be displayed or exposed on the sidewalk
or outside of places of business.
Prepared foodstuffs, such as bakers' goods,
confectionery, shelled nuts, etc.; dried fruits, such as dates, figs,
peaches, prunes, apricots, etc.; cereal products, such as tapioca,
breakfast foods, etc.; pickled products, such as pickles, chili sauce,
etc.; fruit products, such as apple butter, jellies, jams, etc.; meat
products, such as dried, salted or smoked fish, veal loaf, pickled
pigs feet, chipped beef, boiled ham, mincemeat; or other foods prepared
for eating or subject to the attacks of worms or flies shall not be
displayed for sale unless protected from flies, dust and dirt and
all other foreign and injurious contaminants by suitable coverings
of glass, wood or metal.
