The purpose of this chapter is to establish a Conservation Commission,
comprised of not more than nine members, appointed by the Town Board of the
Town of Evans, to serve at its pleasure for a term not exceeding two years,
to assist the Board, in an advisory capacity, to advise in the development,
management and protection of the town's natural resources.
Members of the Evans Conservation Commission shall serve without compensation
of any kind and shall receive no salary for their service.
The Evans Conservation Commission is subject to the town's authority,
as found in § 10 of the Municipal Home Rule Law, as well as being
subject to the powers, duties and responsibilities as found in Article 12-F,
§ 239-x, of the General Municipal Law and Article 47 of the Environmental
Conservation Law pertaining thereto, as well as applicable funding provisions
therein provided.
This chapter shall become effective, retroactive to the passage of the
resolution authorizing the same, July 20, 1994. However, formation of the
Conservation Board is within the discretion of the Town Board, at which time
this chapter shall receive full implementation.
