By the adoption of this article, the Town Board of the Town of Evans
declares its intent to be to regulate, in a manner consistent with the interest,
protection, well-being and safety of the citizens of the Town of Evans, the
use of the beaches along the shores of Lake Erie. The Town of Evans has many
miles of fine sandy shores bordering on Lake Erie. Some people, in the use
thereof, are careless and thoughtless of their own welfare and that of other
users of such beaches in that glass beverage containers are intentionally
broken or carelessly abandoned to become later broken and become a hidden
danger to other users of the beach by causing cuts on the persons of such
users of the beach. Recognizing its responsibility for the welfare of its
citizens and to protect them from injury and in the exercise of its police
power, in these regards the Town Board of the Town of Evans does hereby enact
the following Article.
This article shall apply to all the sand, pebble or stone beaches within
the Town of Evans lying between the waters of Lake Erie and that portion of
the land usually forming the bank or earth embankment constituting the permanent
shoreline.
No person shall throw, deposit, carry or use any glass bottle or other
glass container, bottle, jug, glass or mug, whether empty or containing liquid
of any kind, which receptacle is ordinarily used or designed to contain beverages,
over or onto the beaches of Lake Erie within the Town of Evans.
