This chapter shall be known as "Fires and Fire
Prevention."

Where the provisions of this chapter conflict
with any provisions of the Uniform Fire Prevention and Building Code,
the Uniform Code shall apply.
This chapter shall apply to the territory within
the corporate limits of the Town of Rotterdam.

It shall be unlawful to start bonfires in streets
or other public places.

The enforcement of the provisions contained
within this chapter is hereby designated to the Town Building Inspector/Code
Enforcement Officer and/or any police officer of the Town of Rotterdam.

Any person, firm or corporation who shall violate
any of the provisions of this chapter or any rule or regulation made
pursuant thereto shall, upon conviction thereof, be punished by a
fine of no less than $500 nor more than $1,000 or imprisonment for
a period not to exceed one year, or both, for conviction of a first
offense; for conviction of a second offense, both of which were committed
within a period of five years, punishable by a fine not less than
$1,000 nor more than $1,500 or imprisonment for a period not to exceed
one year, or both; and upon conviction for a third or subsequent offense,
all of which were committed within a period of five years, punishable
by a fine not less than $1,500 nor more than $2,000 or imprisonment
for a period not to exceed one year, or both. Each day of continued
violation shall constitute a separate, additional offense.
