It shall be the duty of the owners of the land abutting upon any curbs, sidewalks and/or driveway aprons to keep them in such repair and condition that they may not be or become dangerous to the welfare and safety of the traveling public. In addition, it shall be the duty of the owners of the land abutting any curb, sidewalks and/or driveway aprons to ensure that storage containers (as that term is defined in Chapter 203, § 203-39), trash, recycling, yard waste, discarded household items awaiting pickup, or any other objects are not placed on such curb, sidewalk and/or driveway aprons such that their placement interferes with the safe and unhindered passage of pedestrians over such curb, sidewalk and/or driveway aprons. The Board of Supervisors of the Township of Falls, Bucks County, Pennsylvania, hereby designates the Code Enforcement Officer to notify property owners when sidewalks, curbs and/or driveway aprons are in need of repair or renewal, and the repair or renewal thereof will be made by the property owners within 30 days after said written notice is given to said property owners. Nothing herein contained shall be construed to place the responsibility of determining when sidewalks may become dangerous to the welfare and safety of the traveling public upon the Township; at all times, such responsibility shall be solely upon the property owner whose land abuts the curb, sidewalk, or driveway apron.
No owner, occupant or person having possession of or the control over any lot or parcel of real property shall permit or cause to be planted any trees within the planting strip between the curb and sidewalk of any real property located within the Township of Falls.

Any person, firm or corporation who violates or permits a violation of this article shall be guilty of a summary violation and, upon conviction, shall be sentenced to pay a fine of not more than $1,000, plus all court costs, including reasonable attorney's fees, incurred by Falls Township in the enforcement of this article. Each day a violation exists shall constitute a separate offense. In default of the payment of any fine, the defendant shall be sentenced to imprisonment to the extent allowed by law for the punishment of summary offenses. Further, the appropriate officers or agents of Falls Township are hereby authorized to file a citation for such summary violation and seek any other available relief at law or equity, including injunction, to enforce compliance with this article.
