The Board by a majority vote of its membership
shall appoint a Township Manager (hereinafter referred to also as
"Manager") for an indefinite term to serve at its pleasure and shall
fix his compensation. At the time of his appointment he need not be
a resident of the township, but residence within the township must
be acquired within 12 months of this appointment, unless exempted
from this requirement by the Board.
The Manager shall be selected on a basis of
his administrative training, professional qualifications and experience,
and he shall not otherwise be gainfully employed except as permitted
by the Administrative Code.
The Manager shall be the chief executive officer
of the township and shall be responsible to the Board for executing
all policies established by the Board and for the proper administration
of all affairs of the township placed in his charge. The Manager shall
have the following powers and duties:
A. With the approval of the Board, to appoint, suspend
and remove department heads, except the Superintendent of Police.
B. To be responsible for the performance of all duties
required of the office of the Township Secretary by general law or
this Charter directly or through such employees as may be set forth
in the Administrative Code.
The Board may remove the Manager at any time
in accordance with the following procedures:
A. The Board shall adopt by affirmative vote of a majority
of all its members a preliminary resolution for his removal and may
suspend the Manager from duty for a period not to exceed 45 days.
A copy of the resolution shall be delivered promptly to the Manager.
B. Within five days after a copy of the resolution is
delivered to the Manager, he may file with the Board a written request
for a statement of the reasons for his proposed removal and a public
hearing with or without legal counsel. This hearing shall be held
at a Board meeting not earlier than 15 days nor later than 30 days
after the request is filed. The Manager may file with the Board a
written reply not later than five days before the hearing.
C. The Board may adopt a final resolution of removal,
which may have been made effective immediately, by affirmative vote
of a majority of all its members at any time after five days from
the date when a copy of the preliminary resolution was delivered to
the Manager, if he has not requested a public hearing, or at any time
after the public hearing if he has requested one.
D. A preliminary resolution to remove the Manager may
be adopted only at a public meeting of the Board.
The Manager shall designate in writing, subject
to approval of the Board, an employee of the township to exercise
the powers and duties of the Manager during his absence or disability.
During such absence or disability, the Board may revoke such designation
at any time and appoint another employee of the township to serve
until the Manager shall return or his disability shall cease. In the
event of a vacancy, the Board shall appoint an employee of the township
to serve as Acting Manager until the vacancy is filled.
The Manager shall at all times keep the Board
fully advised as to the financial condition and administrative activities
of the township, shall provide to the Board at its regular monthly
meetings, and at such other times as the Board may direct, periodic
reports thereon and shall prepare and submit to the Board and make
available to the public an annual report concerning the finances and
administrative activities of the township.
