It shall be unlawful for any owner or person in possession of any lot
or premises within this township to permit the same to be covered with tall
grasses or weeds.
If any owner or person in possession of any lot or premises shall fail
to remove tall grasses and weeds therefrom after five days' written notice
from the Secretary of the Board of Supervisors, said Board may have the work
done at the cost of the property owner and may file a lien therefor against
the property or collect the cost thereof from the property owner in an action
of assumpsit brought in the name of the township. Said notice may be served
upon the property owner personally or by registered mail and, if he has no
residence within the township, by delivering the same in like manner to the
person in charge of said property or posting the notice upon the premises.
Any person who violates or permits a violation of this chapter, upon
being found liable therefor in a civil enforcement proceeding, shall pay a
fine of not more than $600, plus all court costs, including reasonable attorney's
fees, incurred by the township in the enforcement of this chapter. No judgment
shall be imposed until the date of the determination of the violation by the
District Justice and/or Court. If the defendant neither pays nor timely appeals
the judgment, the township may enforce the judgment pursuant to the applicable
rules of civil procedure. Each day a violation exists shall constitute a separate
offense. Further, the appropriate officers or agents of the township are hereby
authorized to seek equitable relief, including injunction, to enforce compliance
herewith.
