As used in this article, the following terms shall have the meanings indicated:
ABANDONED VEHICLEA. A vehicle (other than a pedalcycle) shall be presumed to be abandoned under any of the following circumstances, but the presumption is rebuttable by a preponderance of the evidence:
(1) The vehicle is physically inoperable and is left unattended on a highway or other public property for more than 48 hours.
(2) The vehicle has remained illegally on a highway or other public property for a period of more than 48 hours.
(3) The vehicle is left unattended on or along a highway or other public property for more than 48 hours and does not bear all of the following:
(a) A valid registration plate.
(b) A current certificate of inspection.
(c) An ascertainable vehicle identification number.
(4) The vehicle has remained on private property without the consent of the owner or person in control of the property for more than 24 hours.
(5) The vehicle has remained on the private property of a salvor for 20 days.
B. Vehicles and equipment used or to be used in construction or in the operation or maintenance of highways or public utility facilities, which are left in a manner which does not interfere with the normal movement of traffic, shall not be considered to be abandoned.
DISABLED VEHICLEAny motor vehicle which is inoperable due to mechanical failure or malfunction but is not an abandoned vehicle.
IMPOUNDING AUTHORITYThe authority of the Tredyffrin Township Chief of Police, any Tredyffrin Township peace officer or official having such authority by law to impound any motor vehicle for any lawful reason(s).
MOTOR VEHICLEA vehicle which is self-propelled except an electric personal assistive mobility device or a vehicle which is propelled solely by human power.
OWNERA person, other than a lienholder, having the property right in or title to a vehicle. The term includes a person entitled to the use and possession of a vehicle subject to a security interest in another person, but excludes a lessee under a lease not intended as security.
TOWING BUSINESSThe business of towing or removing disabled or damaged vehicles on the public street or right-of-way.
TOWING COMPANY PERMIT OWNERAny person engaged in a towing business holding a valid permit from the Township for the operation of a towing business.
TOWING VEHICLEAny motor vehicle used for the purpose of towing or removing disabled or damaged vehicles.
VEHICLEEvery device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices used exclusively upon rails or tracks. The term does not include a self-propelled wheelchair or an electrical mobility device operated by and designed for the exclusive use of a person with a mobility-related disability.
WRECKED VEHICLEAny motor vehicle which is disabled due to collision with another vehicle or object.
