A tree warden shall be appointed by the Town
Council pursuant to the Town Charter and Title 2 Chapter 14 of the
Rhode Island General Laws. The Tree Warden shall be both a resident
of the Town and a state-licensed arborist or, if not a licensed arborist,
within six months of their assuming office, the Tree Warden shall
become a state-licensed arborist.
A tree warden whose appointment has been approved
by the Director of the Department of Environmental Management shall
hold office until the first day of March in the year following their
appointment and until their successor is duly appointed and approved.
Any vacancy that may occur in the office of the Tree Warden shall
be filled by the Town Council by the appointment of some person to
serve for the remainder of the term subject to the approval of the
Director.
A.
The Tree Warden shall affirm and endorse the purpose
and intent of the Barrington Tree Ordinance and shall cause the provisions
of this chapter to be enforced.
B.
The Tree Warden shall, with the advice of the Barrington
Conservation Commission and the approval of the Barrington Town Council,
prepare and enact a Tree Management and Annual Tree Planting Program
for the Town of Barrington.
C.
The Tree Warden is further charged with keeping informed
of environmental and technical changes that could affect the Town's
public and protected trees.
D.
The Tree Warden shall communicate and work with all
civic and public interest groups interested in or devoted to tree
care, preservation or planting.
E.
The Tree Warden shall expend all funds which shall
be appropriated by the Town Council for the setting out, care and
maintenance of trees and shrubs on roads and public places under their
control.
F.
The Tree Warden shall enforce all provisions of state
and local law for the presentation of those trees and shrubs and may
make suitable regulations governing the care and preservation of those
trees and shrubs as he may deem expedient, those regulations to be
subject to the approval of the Town Council with the advice of the
Conservation Commission.
A.
The Tree Warden shall have the authority and jurisdiction
of regulating and enacting the maintenance, removal and planting of
public and protected trees to ensure public safety, preserving the
aesthetics of public sites with regard to trees and protecting the
value and health of Barrington's community forest as a whole.
B.
The Tree Warden shall consider the existing and future
utility and environmental factors when recommending a specific species
for each of the streets and other public sites and when issuing permits
for tree work, removal or planting.
C.
The Tree Warden shall have the responsibility of regularly
updating the Tree Management and Planting Program.
D.
The Tree Warden shall have the authority to review
all requests for permits for any planting, removal, pruning and/or
trimming or cutting of trees in any public area, with the exception
of an historic or protected tree. He shall also have the authority
to grant or deny and to attach reasonable conditions to all permits,
with the exception of those specifically exempted herein.
E.
The Tree Warden shall review all requests for permits
for any planting, removal or trimming of trees within any public right-of-way.
The Tree Warden, upon the advice of the Tree Commission, shall grant
or deny and attach reasonable conditions to all permits required under
this chapter.
F.
The Tree Warden shall enforce such rules, regulations
and permit and penalty procedures as are deemed necessary to enforce
the intent of this chapter.
