The requirements of this chapter may be waived by the Director of Public Works in the case of emergencies, such as winter storms, tropical storms, hurricanes or other natural or human-made disasters, so that they in no way shall hinder private or public works to restore order to the Town. All emergency work shall, to the degree practical, follow the standards of this chapter.
The requirements of this chapter shall not apply to decisions of the Director of Public Works or their designee in carrying out the duties and responsibilities of their office. Routine and/or emergency activities of the Department of Public Works required to ensure the public safety shall be exempt from the requirements of this chapter.
No person shall hinder, prevent, delay or interfere with the Tree Warden or any of their assistants while they are engaged in carrying out the implementation of this chapter; provided, however, that nothing herein shall be construed as an intent to prohibit the pursuit of any remedy, legal or equitable, in any court of competent jurisdiction, or the protection of property rights by the owner of any property within the Town.
A. 
The Tree Warden's findings may be appealed to the Tree Commission.
B. 
The Tree Commission, upon receipt of such appeal, on forms provided by the Tree Warden, shall have the authority and duty to consider an act upon the appeal. This application shall clearly and in detail state the grounds of the appeal and shall be accompanied with such supplementary data as is deemed necessary to substantiate the appeal. The Tree Commission may approve, modify or deny the Tree Warden's decision, based upon protection of public interest, preservation of the intent of this chapter and possible unreasonable and unnecessary hardships involved in the case.
C. 
The Tree Commission shall act on the application as expeditiously as possible and shall notify the applicant in writing within 30 days of the action taken.
Any person violating or failing to comply with any of the provisions of this chapter shall be subject to court action and, upon conviction thereof, shall be subject to a fine of up to $1,000 and/or the values of the trees removed or damaged.
If any one or more sections of this chapter shall for any reason be adjudged unconstitutional or otherwise invalid, the judgment shall not affect, impair or invalidate the remaining provisions.
This chapter and any amendment thereto shall be declared to be of immediate necessity for the preservation of public peace, health and safety and shall be in full force and effect from and after its passage and publication provided by law.
