No material from any privy, vault or cesspool or human excreta removed from any place whatsoever shall be deposited or disposed of within the Town of Barrington.
No person, partnership, corporation or association shall engage in the business of removing the contents of a privy, vault or cesspool within the Town of Barrington until they (or it) have obtained a license therefor from the Town Council. This requirement shall not apply to servants or employees of a person, partnership, corporation or association duly licensed.
This license shall be issued, remain in effect and be renewed subject to the following conditions:
A. 
Application.
(1) 
Written application for the license shall be made to the Town Clerk, and the Town Council shall then either grant or refuse the license.
(2) 
At the Council meeting at which the license is being considered, the applicant may appear and present such material evidence as is reasonably relevant to their application.
B. 
Fee. The application shall be accompanied by a fee as set from time to time by resolution of the Town Council.[1]

C. 
Expiration. Every license shall expire on the first day of January next following its issue and must be renewed annually.
D. 
Revocation. Any license issued under this article may be revoked or suspended by the Town Council at any time for any violation of this article, and also for any other cause deemed sufficient in order to preserve or advance public health, provided that no license shall be suspended or revoked without giving the licensee five days' notice of intent to suspend or revoke and a fair hearing in person or by counsel, unless a suspension or revocation is deemed immediately necessary for the preservation of public health.
E. 
Nontransferability. Licenses issued hereunder shall not be transferable.
F. 
Bond. Application, if approved, shall be issued by the Town Council upon the applicant's furnishing a bond an amount set from time to time by resolution of the Town Council with surety or sureties satisfactory to the Town Treasurer, guaranteeing to the Town of Barrington performance by the applicant, if said license is granted, of all the provisions of this article.[2]

Any person, partnership, corporation or association violating any of the provisions of this article shall be fined not exceeding $20 for each offense.
