The septage regulations adopted under this Article XXI of this Part 4 may be supplemented or amended from time to time by resolution of the Sanitary Commission of Queen Anne's County.
Any septage hauler wishing to use the Kent Narrows/ Stevensville/ Grasonville wastewater treatment plant shall have a valid septage discharge permit issued by the Queen Anne's County Sanitary Commission.
A. 
Application. To obtain a septage discharge permit, an applicant shall submit to the Sanitary Commission an application on the form that the Sanitary Commission provides.
B. 
Contents of application form. Application forms shall contain all information pertinent to the safe and efficient treatment of the septage, as determined by the Sanitary Commission.
C. 
Review of application. The Sanitary Commission shall review septage discharge permit applications to determine if the applicant's potential sources of septage and equipment are acceptable for discharge at the Kent Narrows/ Stevensville/ Grasonville treatment facility.
D. 
Permit fee.
(1) 
After a septage discharge permit application has been approved, the applicant shall submit an annual permit fee of $300 before issuance of the permit.
(2) 
The Sanitary Commission shall:
(a) 
Establish the annual fee for a permit; and
(b) 
Review the annual fee each year and amend it accordingly.
E. 
Not transferable. A permit is not transferable.
A. 
Grounds for suspension or revocation. The Queen Anne's County Sanitary Commission may suspend or revoke a permit:
(1) 
To stop the discharge of any material that presents a hazard to the public health, safety, or welfare, or the safe operation of the waste treatment facility; or
(2) 
If a septage hauler is found to have violated any provision of this Part 4.
B. 
Reinstatement of suspended permits. The Sanitary Commission may reinstate a suspended permit on proof of satisfactory compliance with all provisions of this Part 4.
A. 
Location. All permit holders shall discharge their waste at the Kent Narrows/ Stevensville/ Grasonville facility or another facility approved by the Queen Anne's County Health Department.
B. 
Refusal of waste. The Queen Anne's County Sanitary Commission may refuse any waste considered harmful to the treatment facility or receiving body of water.
C. 
Discharge into sanitary sewer manhole prohibited. A person may not discharge waste into a sanitary sewer manhole.
A. 
Treatment charge. In addition to the annual permit fee, a treatment charge of $20 per 1,000 gallons shall be imposed.
B. 
Analysis of septage. The Sanitary Commission periodically shall sample and analyze septage from selected users to determine the biochemical oxygen demand (BOD) and suspended solids loadings, and phosphorus concentrations of the septage.
C. 
Determination of cost of treatment. The results of the analysis shall be used as representative of waste strengths from all septage haulers and shall be used to determine the cost of treatment.
D. 
Special treatment costs. A particular hauler's waste may be analyzed and classified individually for special treatment costs when determined by the Sanitary Commission as creating special handling problems or as being of unusual strength or character.
Any duly authorized employee or agent of Queen Anne's County may, at any time, enter on the property of any customer of a permit holder to inspect, observe, sample, and test, as may be required, to implement and enforce this Article XXI of this Part 4.
A. 
Annual inspection. Any tank trucks or other equipment used or intended to be used in the County for the removal or transportation of septage shall submit to an annual inspection by the Sanitary Commission.
B. 
Requirements.
(1) 
All equipment or vehicles used or intended to be used within the County for the removal or transportation of septage shall meet the requirements of this subsection.
(2) 
The container shall be watertight.
(3) 
Tank containers or other equipment shall be constructed so that every portion of the interior and exterior can be easily cleaned.
(4) 
All equipment shall be kept in a clean and sanitary condition.
(5) 
All piping, valves, and connections shall be accessible and easily disconnected for cleaning purposes.
(6) 
The inlet opening to every container shall be constructed so that the material will not spill during filling, transfer, or transport.
(7) 
The outlet connections shall be constructed so that no material will leak and shall be of a design and type suitable for the material handled and capable of controlling the flow or discharge without spillage, undue spray, or flooding while in use.
