It is hereby prohibited to drink any intoxicating liquor on any sidewalk, street, avenue, highway, public parking lot, park, recreation area or in any vehicle not on private property within the City of Brigantine, Atlantic County, New Jersey, at any time without first applying for and obtaining a special events permit pursuant to the process established at § 210-8 et seq. of this Code and a payment of a fee as established at § 210-37 of the Code coupled with approval of a separate special events license approved by the New Jersey Division of Alcoholic Beverage Control if applicable.

Violations for consumption in public in the City of Brigantine shall be punishable with a fine of $150. If the offending party wishes to appear in Municipal Court and plead not guilty to the citation, the matter will be heard before the Court and upon conviction, the offending party shall be subject to a fine of not more than $2,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment or community service as determined in the discretion of the Municipal Court Judge. Any person found guilty of a second and/or subsequent offense may be prohibited from accessing municipal beaches or recreational areas for a one-year period commencing on the date of conviction.
Copies of this article shall be posted on the beaches of Brigantine, in the City Hall of said City and every place licensed for the sale of alcohol beverages in said City.
