A. 
New Jersey Statutes Annotated (hereafter "N.J.S.A.") 4:19-15.1 et seq. establishes comprehensive regulations for licensing of dogs, kennels, pet shops, shelters and pounds within municipalities of the State of New Jersey. Pursuant thereto, any persons who own, keep or harbor a dog of licensing age within the City of Brigantine shall annually apply for a dog license from the municipal official appointed hereunder and, in addition, obtain from said municipal official a metal registration tag for each such dog. At all times during the term of said license, said persons shall place upon such dog a collar or harness with the registration tag securely attached thereto.

B. 
Every person who applies for any such dog license and registration tag, or any renewals thereof, shall pay a fee to the City of Brigantine in the amounts set forth in Chapter 210, Mercantile Businesses, Article II, Fees Schedule, according to the following schedule:

(1) 
A license fee to the City of Brigantine pursuant to N.J.S.A. 4:19-15.12.
(2) 
A registration tag fee due to the New Jersey State Department of Health pursuant to N.J.S.A. 4:19-15.3.
(3) 
A fee due to the New Jersey State Department of Health for any dog of reproductive age which has not had its reproductive capacity permanently altered through sterilization as part of implementation of the Animal Population Control Fund pursuant to N.J.S.A. 4:19-15.3b.
(4) 
A fee due to the New Jersey State Department of Health for deposit in a pilot clinic fund to be used for operation of a pilot spay-neuter clinic.
(5) 
A late charge for failure to obtain any license or pay any fee required by this article after March 1 of any calendar year.
C. 
Every person who applies for any dog license and registration tag or any renewals thereof shall provide such information as is requested by the City of Brigantine for its annual dog canvass, on forms provided for such purpose. In addition, every person keeping or having any dog within the boundaries of the City of Brigantine shall provide such information, from time to time, as is required by the regulations of the New Jersey Health Department, concerning dogs, pursuant to New Jersey statutes.

D. 
All such licenses, registration tags and renewals thereof shall expire on January 31 in the year stated on the license.

A. 
Any person owning or in charge of any dog which defiles, defecates on or commits any nuisance on any common thoroughfare, sidewalk, beach, passageway, bypath, play area, park or any place where people congregate or walk or upon any public property whatsoever or upon any private property without the permission of the owner of said property shall immediately remove feces deposited by any such dog by any sanitary method approved by the local enforcement authority. Material so removed shall be disposed of by the person owning or in charge of any such dog through a sanitary method as through the use of pooch scoops, small shovels, etc.
B. 
The owner or person in charge of such dog shall remove and dispose of sealed, nonabsorbent, leakproof container, such as a sealed plastic bag; such material shall not be disposed of in public trash receptacles or storm drains.
C. 
Any owner or person in charge of a dog being walked upon any common thoroughfare, sidewalk, beach, passageway, bypath, play area, park or any place where people congregate must have in their possession their cleanup device and nonabsorbent, leakproof container.
D. 
The requirements of this section shall not apply to any dog when used as a guide for any person who is legally blind.

It shall be unlawful for any dog, whether licensed or not, to run at large anywhere within the limits of the City of Brigantine. A dog shall be deemed to be running at large when off the premises of its owner or of the person keeping or harboring such dog and not on a leash or the like, the overall length of which, including the hand grip, shall not exceed six feet held by its owner or other person able to control such dog.

A. 
No dogs shall be taken or permitted upon any public beaches between 14th Street North and the southwesternmost portion of the beaches of the City of Brigantine between May 30 and September 30, inclusive, and no dog shall be taken or permitted on said beaches between October 1 and May 29 each year unless said dog shall be securely fastened to a leash and accompanied by and under the control of a person.
B. 
Dogs are prohibited at all times from all public parks and playgrounds whether on a leash or not, whether licensed or not.
C. 
Dogs are prohibited at all times from the promenade upon the seawall extending from 9th Street North to 15th Street North, whether on a leash or not, whether licensed or not.
D. 
Dogs are prohibited on public school grounds.
No person shall harbor or keep any dog within the boundaries of the City of Brigantine that habitually barks so as to disturb the peace and quiet of the persons residing in said City.

A. 
The Brigantine Police Department, Animal Control Officer or any other appropriate City official may cause a hearing to be held in the Municipal Court of the City of Brigantine for a determination and declaration as to whether a dog is potentially dangerous and/or vicious.

B. 
No person shall keep or harbor any vicious dog anywhere within the limits of the City of Brigantine.

A. 
The City Clerk of the City of Brigantine is hereby appointed as the municipal official charged with the responsibility to issue dog licenses and registration tags, to collect the fees established therefor, to provide for disposition of such fees and to perform all such additional duties as set forth in N.J.S.A. 4:19-15.1 et seq. and any regulations of the New Jersey State Department of Health established thereunder, except those duties delegated to the municipal official pursuant to Subsection B hereafter.
B. 
The provisions of this article shall be enforced by the Animal Control Warden, members of the Brigantine Police Department, Brigantine Public Works Department, Code Enforcement Department and any other City employees or official designated by the City Manager.

Except as provided in N.J.S.A. 4:19-15.1 et seq., any person who violates the provisions of this article shall be subject to a fine not less than $100 nor more than $1,000 or imprisonment for not more than 90 days, or both, and may also be required to perform community service.
