A. 
The provisions of this article imposing a time limit or other restrictions on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
B. 
The provisions of this article shall not relieve any person of the duty nor limit the penalty for failure to observe specific regulations adopted by ordinance or otherwise in accordance with law concerning the parking or operating of vehicles on municipally owned real property not located within the right-of way of any public street or upon those areas of the City of Brigantine designated as public beaches, dune areas or other regulated areas. Regulations concerning such municipal parking lots, beaches and dune areas are found in other chapters of the Code[1] and the duties and penalties established thereby shall not be affected by the adoption of this article and shall remain in effect until such specific Code sections are altered, amended or repealed.

No person shall stop or stand a motor vehicle upon any of the streets or parts of streets described in Schedule XV (§ 284-51), included herein and made a part of this chapter.
No person shall park a vehicle between the hours specified in Schedule XVI (§ 284-52), of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVI, included herein and made a part of this chapter.
No person shall stop or stand a vehicle during the times specified in Schedule XVII (§ 284-53), of any day, unless otherwise indicated, upon any of the streets or parts of streets described in Schedule XVII, included herein and made a part of this chapter.

The parking of any trucks, box trucks or other commercial vehicles of any kind having a gross weight in excess of 8,100 pounds or a cargo capacity in excess of one ton net, or any motor homes, camping trailers or other mobile residential-type trailers shall be prohibited on the streets of the City of Brigantine between the hours of 11:00 p.m. and 6:00 a.m., unless being actively used in commercial activity or emergency during said time. A stand-alone construction trailer shall be a trailer used in the construction industry which is not attached on a permanent basis to any truck or other motor vehicle. Stand-alone construction trailers must be located on the actual lot where construction occurs and cannot be left on any City street, highway, alley, lane or boulevard for a period in excess of 24 hours without advanced notice to the Police Department of the City of Brigantine and permission being granted by the Chief of Police or his designee. The City of Brigantine may remove any such stand-alone construction trailer or vehicle if the owner of the same cannot be contacted or if any public emergency arises requiring said vehicle to be removed. The cost of any such removal shall be borne by the owner of said vehicle or the contractor using said vehicle. The owner, general contractor or other individual using the vehicle or construction trailer may be cited for any violation of this section.
No person shall park a vehicle for longer than the time limit shown in Schedule XVIII (§ 284-54), at any time between the hours listed in said Schedule XVIII of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVIII, included herein and made a part of this chapter.
It shall be unlawful for any person to park any motor vehicle in the public streets of the City of Brigantine for a continuous period of more than 48 hours in such places as parking is authorized, unless the owner or operator of said motor vehicle owns, leases or occupies the property in front of which said motor vehicle is parked.
No person shall park a vehicle upon any streets or parts thereof described in Schedule XIX (§ 284-55), except at the angle designated and only within the painted white stall lines.
The locations described in Schedule XX (§ 284-56), included herein and made a part of this chapter, are hereby designated as loading zones. No person shall park a vehicle in said location during the times indicated other than for the loading or unloading of goods and materials.

No taxicab of any nature shall be parked on or in any street, boulevard, avenue, road, highway, cul-de-sac, alley or other area of public travel within the City of Brigantine except for the purpose of picking up or dropping off passengers. This section is specifically intended to prevent the parking of taxicabs in the City of Brigantine in any district, whether it be residential or commercial, except for the stated purpose of picking up or dropping off passengers.
The locations described in Schedule XXII (§ 284-58), included herein and made a part of this chapter, are hereby designated as bus stops.

A. 
The locations described in Schedule XXIII (§ 284-59), included herein and made a part of this chapter, are hereby designated as handicapped parking spots.
B. 
Any resident of the City of Brigantine possessing a valid New Jersey driver's license who has qualified for a handicapped parking permit from the State of New Jersey may apply to the City of Brigantine for a restricted handicapped parking space located near their residence. The application shall be submitted to the City Manager with a current copy of the applicant's handicapped parking permit and valid driver's license issued by the State of New Jersey.
C. 
Consideration will be given to non-driving applicants for restricted curbside spaces providing that it is shown that there is a hardship in dropping off the handicapped applicant at their residence and subsequently parking the vehicle at another location. The nondisabled driver must reside in the same household as the disabled person and provide verification of such status.
D. 
Restricted handicapped spaces will not be provided to applicants who have access to driveways and/or to other off-street parking facilities. However, if the applicant can demonstrate that off-street parking is not accessible or practical due to the nature of their disability, a hardship exception can be granted. To qualify for an exception, applicant must submit an application, along with medical documentation, to the City of Brigantine that supports need for a restricted handicapped parking space located in front of their residence, even if applicant has access to a driveway or to other off-street parking facilities.
E. 
The number of handicapped restricted spaces on each City block will be limited: Two spaces will be allotted per street side per block with a maximum of four available spaces. The intent is to provide a fair distribution of accessible spaces that are compliant with the above guidelines to both handicapped and nonhandicapped residents of the City.
F. 
Applicants shall have the option of requesting a designated space with a personal restriction that shall be defined by their New Jersey license plate number being printed on the signs delineating their space which shall be established by ordinance.
G. 
There will be a one-time fee of $75 for a restricted handicapped parking space. All handicapped parking spaces shall be subject to annual review. Applicants shall be required to provide a copy of current status of valid New Jersey handicapped status, driver's license and vehicle registration.
H. 
Restricted handicapped spaces designated by ordinance shall be listed in § 284-59, Schedule XXIII: Handicapped Parking.
I. 
A handicapped parking permit may be suspended or revoked by the City of Brigantine if the holder thereof has committed fraud or misrepresentation in any application for a permit or in the use of such handicapped parking permit or has violated any provision of this chapter. Additionally, any individual to whom a restricted spot has been granted who is found to be regularly utilizing on-street parking in the immediate vicinity of the location of the restricted space that has been provided to such individual, instead of utilizing such restricted space, shall be subject to suspension or revocation of such restricted parking space. No suspension or revocation shall occur prior to a hearing being held before an Administrative Board, to consist of three persons: the City Clerk, the City Manager, and the Chief of Police. Prior to such hearing, the affected person(s) and/or firm(s) shall receive notice of said hearing and shall have an opportunity to present a defense.

The parking of boats and/or trailers shall be prohibited within the City of Brigantine from December 1 through and including May 1 of each and every year. Between May 2 and November 30 of any year, it shall be unlawful for any person to park any boat or trailer in the City of Brigantine for a continuous period of more than 48 hours in such places as parking is authorized unless the owner or operator of said boat or trailer owns or leases the property in front of which said boat or trailer is so parked. Between May 2 and November 30 of any year, boats may be parked for longer than a period of 48 hours in any street in front of any legally operated and licensed marina on the same side of said street as said marina but only within the area between the property lines of said marina property if said lines were extended into said street in front of said property.[1]

A. 
Whenever snow has fallen and the accumulation is such that is covers the streets or highway, no vehicle shall be parked on either side of any of the streets or parts thereof described in Schedule XXV (§ 284-61), included herein and made a part of this chapter.
B. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

A. 
Upon the declaration of an emergency, there shall be no parking upon streets or parts of streets where temporary emergency no parking signs are displayed. The Emergency Management Coordinator, or the Coordinator's designee, is authorized to declare an emergency and to direct the posting of said emergency no parking signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic, or to take appropriate steps to eliminate parking or travel over public streets or portions thereof.
B. 
Notification that the emergency no-parking signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs whenever possible or practical, given the nature of the emergency.
