Hours for establishments selling alcoholic beverages — See Ch. 144.
A.
Purpose. The purpose of this chapter is the regulation
of opening and closing hours of certain retail business establishments
to which the public is invited in the interest of the protection of
the employees, patrons and law enforcement officers within the Borough
of Franklin Lakes. It has been determined that unprotected and understaffed
businesses and commercial retail enterprises are prey to the criminal
element in our society during the late night and early morning hours.
B.
Scope. This chapter and the hours of opening and closing
described herein shall apply to all businesses operating within the
Borough of Franklin Lakes which invite the public onto its premises
for the sale of goods, merchandise, food or other materials directly
to said public. It is further declared that the regulation of hours
of various retail businesses is necessary to avoid the noise, inconvenience
and disturbance to residential areas in which said businesses are
located or are adjacent to. It is further declared and determined
to be in the best interest of the health, safety and welfare of the
residents of the Borough of Franklin Lakes that said retail businesses
regulated by this chapter cease the conduct of their business at the
hours described herein.

A.
Except as otherwise provided in Chapter 144 for premises with an alcoholic beverage license, restaurants and diners may be open to the public from 5:00 a.m. to 3:00 a.m.
B.
All other businesses regulated by this chapter may be open to the
public from 5:00 a.m. to 12:00 midnight.
C.
This chapter shall not preclude the businesses covered hereunder
from supplying stock, receiving merchandise or otherwise servicing
said business.
Any person who shall violate a provision of
this chapter shall, upon conviction thereof, be punished by fine not
exceeding $500 or by imprisonment for a term not exceeding 90 days
or both. A separate offense shall be deemed committed on each day
during or on which a violation occurs or continues.
