As used in this chapter, the following terms shall have the meanings indicated:
CONSENT AND APPROVAL
The consent to and approval of the location and establishment of a cemetery or the enlargement of an existing cemetery, by the governing body of the Borough, as required by N.J.S.A. 8A:1-1 et seq., as amended.
All applications for consent and approval shall be filed with the Borough Clerk in writing. An application shall have appended thereto or be accompanied by:
A. 
A consent of the applicant to be bound by the terms and conditions set forth in this chapter.
B. 
A descriptive map or plot plan of the premises proposed to be used and occupied for a cemetery or the enlargement thereof and showing the location of the structures referred to in § 193-5B(2) hereof, the bumper strips referred to in §§ 193-6 and 193-7 hereof and the roads and approaches referred to in § 193-8 hereof.
All applications shall be acted upon by the Council within 60 days after filing of such applications.
All consents to and approvals of the location and establishment of cemeteries in the Borough shall be limited to the memorial-park type of cemeteries.
A. 
No monuments, tombstones, crypts or markers shall be installed within any cemetery; provided, however, that bronze, marble, granite or other metal or stone plaques lying flat upon the ground may be installed.
B. 
No mausoleums or other structures shall be erected within any cemetery; provided, however that:
(1) 
Sculptures may be erected to identify areas in the cemetery.
(2) 
There may be erected for use in operating the cemetery, in appropriate locations and as set forth in the application for consent and approval, a chapel, a receiving vault, an office with residence quarters for the superintendent or caretaker and family, and service buildings.
A buffer strip of land not less than 250 feet wide shall surround the land for which consent and approval is given to locate and establish a cemetery. Upon the land a street, not less than 50 feet in width, may be built on its periphery, and fronting upon the street, residences may be built on plots of land in accordance with the requirements of the applicable residence zoning districts in Chapter 300, Land Use and Development, of the Code of the Borough of Franklin Lakes.
A buffer strip of land inside of the boundaries of the land for which consent and approval is given shall be landscaped and planted to provide, as soon and as far as is feasible, a visual shield to the adjacent residential property.
The cemetery shall be planned as to its roads, road approaches and exits so as to provide, as far as possible, for the avoidance of traffic congestion on the public highways of the Borough by the passage of funeral processions.
The cemetery premises shall be developed and maintained in such manner, through the use of shrubbery, trees, foliage and otherwise, as to establish, as far as feasible, a park-like appearance. To the extent possible, the cemetery area shall be maintained as a place of beauty.
Subject to the approval of the Council, signs of a type and size suitable to identify the cemetery itself, its areas, roads, paths and buildings may be erected on the cemetery premises. No excessively large signs shall be permitted on the cemetery premises.
In the consideration of applications for consent to and approval of location and establishment of cemeteries, the Borough shall not incur any expense or costs, but costs for advertising and any other required costs arising from the submission and consideration of the application shall be paid by the applicant.
Every application for a consent and approval under this chapter shall contain an agreement by the applicant that, upon the approval of the application by the Borough, the applicant will pay to the Borough a sum or money equivalent to the amount of taxes on the cemetery land for the year in which the approval is made, and will thereafter, for an additional period of four years, annually pay a like sum to the Borough. The payments made in compliance with this section shall be in lieu of any statutory exemption from taxes of land used for cemetery purposes.
