Township of Montclair, NJ Article I General Provisions

§ 51-1 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:

APPROPRIATE AUTHORITY

Township Manager.

CHIEF

The Chief of the Police Department of the Township.

DEPARTMENT

The Police Department of the Township.

MANAGER

The Township Manager, Chief Executive Officer of the Township.

MEMBERS or MEMBERS OF THE DEPARTMENT

All regular and probationary members of the Police Department of the Township irrespective of rank or duty.

OFFICER

A member of the Department of the rank of Sergeant or higher.

PHYSICIAN or DEPARTMENT PHYSICIAN

The physician appointed by the Township.

REGULAR MEMBER or REGULAR MEMBERS OF THE DEPARTMENT

All members of the Police Department irrespective of rank or duty, except probationary patrolmen.

RULES AND REGULATIONS or ADMINISTRATIVE RULES AND REGULATIONS

The administrative rules and regulations promulgated by the Chief of Police as provided in this article.

§ 51-2 Promulgation of rules and regulations.

The Manager shall, from time to time, promulgate administrative rules and regulations in the manner provided in § 51-3. They shall provide in detail for the management, operation and conduct of the Police Department and its members and shall implement the provisions of this chapter. The rules and regulations so promulgated shall be binding on the Police Department and its members equally with the provisions of this chapter.

§ 51-3 Procedure for promulgation of rules.

A. Rules and regulations shall be deemed promulgated when:

(1) Issued in writing;

(2) Signed by the Manager and Chief;

(3) Filed in the office of the Municipal Clerk; and

(4) A copy thereof is posted on the departmental bulletin board.

B. Thereafter such rules and regulations shall be in effect and binding.

§ 51-4 Continuation of existing rules.

The rules and regulations promulgated by the Director on May 2, 1950, as amended and supplemented, are continued in full force and effect and shall be deemed to implement this chapter. The Manager may amend or repeal all or any part of such rules and regulations or may make and establish such new or additional rules and regulations as may be expedient and proper for the better conduct efficiency or management of the Department.

§ 51-5 Familiarity of police with rules; copies.

It shall be the duty of every member of the Department to familiarize himself or herself with this chapter and with the rules and regulations, together with any changes, additions or amendments thereof. For that purpose, a copy of this chapter and of the rules and regulations in printed form shall be issued to each member of the Department.
