A code regulating premises on which swine are maintained; establishing minimum standards governing the location and maintenance of such premises; authorizing inspections of such premises; declaring and defining certain acts or conditions on such premises as nuisances; and declaring and fixing penalties for violations thereof is hereby adopted pursuant to Chapter 188, P.L. 1950 (N.J.S.A. 26:3-69 to 26:3-69.6). A copy of said code is annexed hereto and made a part hereof without inclusion of the test thereof herein.
Said code established and adopted by this chapter is described and commonly
known as the "Maintenance of Swine Code of New Jersey (1957)."
Three copies of said Maintenance of Swine Code of New Jersey (1957)
have been placed on file in the office of the Secretary of the Board of Health
upon the introduction of this chapter and will remain on file in said office
for the use and examination of the public.
No person shall maintain swine, as defined in said code, on premises
within the boundaries of this municipality until a valid permit therefor shall
have been issued by the Board of Health. Those persons now maintaining swine
under a prior ordinance shall not be obliged to obtain a new permit until
the expiration of the permit issued under said prior ordinance.
Permits required by this chapter or code may be denied or suspended
by the Board of Health for failure to comply with this chapter or code. The
Board of Health shall afford the person whose permit to maintain swine on
premises has been denied or suspended an opportunity to be heard in public
hearing and, following this, to be informed of the Board's decision within
two weeks thereafter.
The fee for a permit to maintain swine on premises shall be $10 annually.
Permits issued for the maintenance of swine on premises shall expire
annually on April 1 of each year, and application for renewal thereof shall
be submitted together with the required fee prior to April 1 of each year.
Under no circumstances shall any person maintain more than four swine.
Additionally, this section shall be interpreted to mean that no more than
four swine may be maintained upon any property where a residence is situate.
Any person who violates or neglects to comply with any provision of
this chapter or code established herein or notice issued pursuant thereto
shall, upon conviction thereof, be liable to a penalty of not less than $2
nor more than $500 for each violation.
