GENERAL REFERENCES
Vehicles and traffic — See Ch. 235.
A.
For the purpose of this chapter the words "vehicle,"
"owner" and "parked" shall have the meanings regularly ascribed to
them by the Vehicle and Traffic Law of the State of New York.
B.
ABANDONED
PUBLIC HIGHWAY
PUBLIC PLACE
As used in this chapter, the following terms shall
have the meanings indicated:
Any vehicle left unattended as ascribed by § 1224
of the Vehicle and Traffic Law of the State of New York.
Any street open to the public for its full width from property
line to property line, including the sidewalk area, whether or not
installed.
Any property available to or open to use by all or a majority
of the property owners or residents of the Village of Atlantic Beach.
A.
When any vehicle is parked, found unattended or abandoned
on any public highway or public place within the Village of Atlantic
Beach during a snowstorm, flood, serious fire or other extreme public
emergency which affects that portion of the public highway or public
place upon which said vehicle is located, or when any vehicle is parked
or found unattended or abandoned on any public highway or public place
and constitutes an obstruction to traffic, or when any vehicle is
parked on any public highway or public place and found unattended
or abandoned at a place where stopping, standing or parking of vehicles
is prohibited, or left abandoned or unattended as ascribed by § 1224
of the Vehicle and Traffic Law of the State of New York, said vehicle
may be removed, towed or caused to be removed by the Mayor, any member
of the Board of Trustees, Police Commissioner, Village Clerk, or by
any Police Officer or any employee of the Police Department of Nassau
County, New York.
B.
No person shall park any vehicle on any public or
private road within the corporate limits of the Village of Atlantic
Beach for more than 48 hours regardless of any other parking regulations.

C.
No vehicles
shall be permitted to be parked, kept or stored on any residential
property unless such vehicle is on a paved driveway. All driveways
shall be accessible from a legal Village street only. At no time shall
any vehicles be permitted to be parked in the rear yard, lawns, or
patios in any residential area.

No person shall park any commercial vehicle,
including a taxicab, livery, limousine, truck, van, trailer, or camper,
on any private driveway, public highway, private road or private property
within the corporate limits of the Village of Atlantic Beach at any
time.

A.
Except as provided for in statute or other regulations, inoperative
or unlicensed motor vehicles shall not be parked, kept or stored on
any premises, and no vehicle shall at any time be in a state of major
disassembly or disrepair or in the process of being stropped or dismantled.
Painting of vehicles is prohibited unless conducted inside an approved
spray booth.

B.
Exception: A vehicle of any type is permitted to undergo
major overhaul, including body work, provided that such work is performed
inside a structure or similarly enclosed area designed and approved
for such purposes.
After such removal, said Mayor or member of
the Board of Trustees, Police Commissioner, Village Clerk, Police
Officer or any employee of the Police Department of Nassau County,
New York, may cause such vehicle to be stored in a suitable place
at the expense of the owner. Such owner or person in charge of said
vehicle may redeem the same upon payment to the Incorporated Village
of Atlantic Beach of the amount of all expenses actually and necessarily
incurred in effecting such removal, at the prevailing rate, together
with any charge for storage, such storage charge not to exceed the
prevailing rate.

Said Mayor, member of the Board of Trustees,
Police Commissioner, Village Clerk, Police Officer or any employee
of the Police Department of Nassau County shall, without delay, report
the removal and disposition of such vehicle to the Village Clerk,
and said Village Clerk shall make reasonable effort to ascertain the
owner of such vehicle or person having same in charge, and to notify
such person of the removal and disposition of such vehicle and of
the amount of the redemption charges.

Any person who shall park a vehicle, found unattended
or abandoned on any public highway or public place within the Village
of Atlantic Beach during a snow storm, flood, serious fire or other
public emergency which affects that portion of the public highway
or public place upon which said vehicle is located, or when any vehicle
is parked or found unattended or abandoned at a place where stopping,
standing or parking of vehicles is prohibited, shall be punished by
and subject to a fine as set forth in § 1224, Subdivision
7(a), of the Vehicle and Traffic Law.
