This chapter shall be known and may be cited as the "Subdivision Regulations of the Village of Colonie."
Before any person, corporation or other entity sells, conveys or transfers or offers to sell, convey or transfer any parcel created by the subdivision of land, said person, corporation or other entity shall obtain final approval of the final development plan(s) by the Planning Commission and shall comply with the provisions of this chapter. "Subdivision" shall mean the division of any parcel of land into two or more lots, plots, sites or other division of land for the purpose, whether immediate or future, of transfer of ownership or building development and shall include resubdivision.
A. 
It is declared to be the policy of the Village Planning Commission to consider land subdivisions as part of a plan for the orderly, efficient and economical development of the Village of Colonie. Land to be subdivided shall be of such character that it can be used for building purposes without danger to health or peril from fire, flood or other menace. Proper provisions shall be made for drainage, water, sewerage and other needed improvements. The proposed streets shall compose a convenient system to conform to the Official Village Map and shall be properly related to the proposals shown on the Town of Colonie Map, if applicable. Streets shall be of such width, grade and location as to accommodate the prospective traffic, to afford adequate light and air and to facilitate fire protection. In proper cases, park areas of suitable location, size and character for playground or other recreational purposes shall be shown on the subdivision plat as to add to the harmonious development of the community. If the Planning Commission determines that a suitable park or playground of adequate size cannot be properly located on such subdivision plat, money in lieu of land shall be required in accordance with these regulations. The amount to be required shall be as determined by the Village Board from time to time. (See Chapter A246, Fees.)
B. 
The rules and regulations which are herein set up are for the purposes of providing for the future growth and development of the Village of Colonie and of affording adequate facilities for the housing, transportation, distribution, comfort, convenience and safety, health and welfare of the people of the Village of Colonie, County of Albany and State of New York.
C. 
The preliminary subdivision plan of a proposed development should be based upon accurate knowledge of existing site conditions and topography. It should include the entire land holding to be developed by the sponsor. However, before either a topographic map or a preliminary subdivision plan is prepared, the sponsor should have initial conferences with the Village Planning Commission.
D. 
Subdivision regulations shall include and apply to the design of all construction, reconstruction, modifications or other work by all other governmental agencies on land and or man-made improvements on land within the geographical boundaries of the Village of Colonie. Said governmental agencies include but are not limited to various local school, fire, water and sewer districts; all of the legally constituted departments, authorities and commissions, etc., of the Town of Colonie, County of Albany, State of New York; and the federal government of the United States.
