GENERAL REFERENCES
Vehicles and traffic — See Ch. 131.
As used in this chapter, the following terms shall have the meanings
indicated:
Every two- or three-wheeled device upon which a person or persons
may ride, propelled by human power through a belt, a chain or gears, with
such wheels in a tandem or tricycle, except that it shall not include such
a device having solid tires and intended for use only on a sidewalk by preteenage
children.
The parent or guardian of any minor shall not authorize or knowingly
permit any such minor to violate any of the provisions of this chapter.
It shall be unlawful for any resident of the Village to operate, use
or permit to be used or operated, or rent for use, any bicycle upon any of
the streets, parks or public places in the Village without first registering
the bicycle and obtaining a license therefor.
The Chief of Police is authorized to issue a bicycle license to the
owner of any bicycle upon:
A.
Approval by the Chief of Police or his designee that
the bicycle is in good mechanical condition and is equipped in compliance
with the applicable provisions of the Vehicle and Traffic Law of the State
of New York.
B.
An application containing the name and residence of the
owner, and if the owner is under 18 years of age, also the name of the parent
or guardian; a brief description of the bicycle to be registered, including
the name of the manufacturer, serial number and color of said bicycle.
C.
The payment of the fee herein provided.
Bicycle licenses shall be numbered consecutively, with the words "Village
of Hempstead" thereon, and shall be attached to the bicycle by the Chief of
Police or his designee.
The fee to be paid for registration of each bicycle shall be $0.25.
In the event a bicycle license is mutilated, damaged, lost or stolen, a new
bicycle license shall be issued upon payment of a fee of $0.25.
It shall be unlawful for any person to willfully or maliciously remove,
destroy, mutilate or alter the serial number of any bicycle frame or the bicycle
license issued pursuant to this chapter. If any changes or alterations are
made on any bicycle license, said bicycle license shall be void. However,
nothing in this section shall prohibit the Chief of Police or his designee
from stamping numbers on the frame of bicycles on which no serial number can
be found or on which said number is illegible or insufficient for identification
purposes.
The Chief of Police shall have the authority to suspend or revoke the
registration of any bicycle licensed under this chapter and may order the
removal of the bicycle license from any bicycle operated contrary to the provisions
of this chapter or operated in violation of the applicable provisions of the
Vehicle and Traffic Law of the State of New York.
The Police Department shall have the authority to impound and retain
possession of any bicycle operated in violation of this chapter and retain
possession of same until the license provided for herein is obtained by the
owner of said bicycle, and the Police Department is authorized to collect
a storage charge of $1 per week unless said bicycle is redeemed by the owner
and a bicycle license obtained within 10 days.
No person shall park a bicycle upon a street other than upon the roadway
against the curb or upon the sidewalk or against a building or at the curb
in such manner as to afford the least obstruction to vehicular and pedestrian
traffic.
