No person shall install, alter or repair, or
cause or permit to be installed, altered or repaired, any electrical
installation within the scope of this chapter except a person holding
a master electrician's license of the Village, the holder of a limited
license as hereinafter provided or a person employed by a holder of
a master electrician's license; except that this chapter shall not
apply to any electrician or helper employed by the State of New York
or any political subdivision thereof, nor to an electrician or helper
employed by any public utility company when employed in the business
of the State of New York, any political subdivision thereof or such
public utility company.

A.
An individual may apply to the Electrical License
Board, hereinafter described, for a master electrician's license,
provided that the applicant has obtained his majority and has at least
five years' practical electrical experience. Said Board shall determine
the fitness of the applicant by such examination as it may deem proper.
The fee for such examination shall be $35 payable in advance. The
fee for any license issued pursuant to this section shall be $150.
Any person who has received a license pursuant to this section and
who, in the course of his employment, desires to open a public highway
or sidewalk, shall provide, in addition to any other requirement of
the Village of Hempstead for a street opening permit, a surety and
street opening combination bond with a company approved by the Village
in the amount of $2,000 for the faithful and complete compliance with
the Electrical Code and the Streets and Sidewalks Chapter of the Village,
which bond shall remain in effect until the street or sidewalk opening
has been repaired to the satisfaction of the Village.
B.
The annual license fee shall be $50. In the event
that the holder of a license does not apply for a renewal of the license
before the 31st day of January following the expiration of his license,
said license shall be deemed to have expired and may be renewed upon
payment of a fee of $150, if application for renewal is made within
one year from the date of expiration. Renewal applications made more
than one year after the date of expiration shall be treated as a new
application, which will require the Electrical Board's approval
to take a new exam.

All applications for master electrician's licenses
shall be made to the Electrical Inspector in such form as he may,
from time to time, prescribe. The application shall be referred to
the Electrical License Board, which shall promptly investigate and
report to the Board of Trustees as to the fitness of the applicant
and make a recommendation concerning the application. All licenses
shall be issued by the Mayor and countersigned by the Village Clerk
and the Superintendent of the Building Department.

The term of each license shall be for a period
of two years beginning on January 1 and terminating on the 31st day
of December the second year.
A.
Name of licensee. An application for a master electrician's
license may be made in the name of an individual, partnership or corporation,
but the name of the licensee must, in each case, be that of the individual
who executes the application and meets the other requirements of this
chapter.
B.
Identify of applicant. Each application for a master
electrician's license shall be verified under oath and shall set forth
the full name, place of residence, business address and telephone
number of such applicant, and if the applicant is a partnership or
corporation, the foregoing information shall be provided for each
partner and each officer. An applicant on behalf of a partnership
or corporation shall be a partner or officer of said entity.
C.
The applicant shall submit on business or company letterhead the
applicant's current address and telephone number. A partnership
application can only be submitted by a partner of a partnership or
an officer of a corporation. If the applicant is a partnership or
a corporation, the current address and telephone number of each partner
or officer must be provided.

A.
Photographs. All applications for licenses under this chapter shall
be accompanied by a copy of a current New York State driver's
license and two photographs of the applicant taken not more than 60
days before the submission of the application, which photographs shall
be two inches by two inches showing the head and shoulders of the
applicant. One photograph shall be affixed to the application and
the other to the renewal record card.

B.
Certificate of registration. Where an applicant intends
to conduct business under an assumed name, trade name or partnership,
there shall be filed, together with the application, a certified copy
of the certificate of registration of such name as required by appropriate
laws of the State of New York.
C.
Certificate of incorporation. Where an applicant is
a corporation, there shall be submitted, together with the application,
a certified copy of the certificate of incorporation, a certified
copy of the certificate of assumed name, if any, and a statement giving
the name and residence address of each of the officers of the corporation.
Immediate notice in writing shall be given the Electrical License
Board of any change in the identity of such officers or any change
in their addresses.
D.
Insurance. An applicant must present a copy of a commercial liability
policy, issued by an insurance company licensed to do business in
New York State, evidencing a minimum of $1,000,000 in coverage for
each occurrence and a combined excess policy of at least $2,000,000.
An applicant who has any employees shall submit with the applications
for electricians' licenses a certificate of workers' compensation
insurance as required by appropriate laws of the State of New York.

E.
Examination fee. All applications for an electrician's
license shall be accompanied by a nonrefundable examination fee of
$35.

Renewals of licenses of electricians entering
the Armed Forces or Merchant Marine of the United States shall be
extended, without charge, to include the year of discharge from such
service.
A.
Any license may be suspended or revoked by the Board
of Trustees upon recommendation of the Electrical License Board for
any violation of the provisions of this chapter, after a hearing duly
held by such Electrical License Board. Notice of the hearing for suspension
or revocation of a license, setting forth the grounds of the complaint
and the date, time and place of hearing, shall be given in writing
by mail, postage prepaid, to the licensee at his last known address
at least 10 days prior to the date of hearing.
B.
Licenses may be suspended or revoked in accordance with Subsection A above for violation of any of the provisions of this chapter and for any of the following causes:
(1)
Failure to display license at established place of
business.
(2)
Failure to obtain electrical permit prior to the installation
of electrical work.
(3)
Upon receipt of violation notice, failure to take
action called for in such notice.
(4)
Performance of electrical work in a manner contrary
to the requirements of this chapter.
(5)
Any improper or fraudulent practice.
(6)
Renting or lending a license.
(7)
Conviction of a felony or misdemeanor.
(8)
Altering or defacing a certificate of electrical inspection
or an electrical permit.
(9)
Obtaining a permit for work to be performed by an
individual, firm or other entity not licensed by the Village of Hempstead
as a master electrician.
(10)
Failure to securely attach the original copy of such
electrical permit on or near the meter location or entrance switch
on the job for which such permit is issued.
C.
The name of the licensee and the address thereof shall
be inscribed upon the sides of any vehicle used in connection with
the licensed activity when working within the Village; such inscription
may be a metallic or plastic sign with magnetic attachment or permanently
painted on the vehicle.
D.
The license sticker issued with the license is to be displayed on
the rear of any vehicle that shall be used when performing electrical
work in the Village. Additional stickers may be requested in writing,
provided that the vehicle is registered, owned or leased by the licensee.

The examination for an electrical license shall consist of a
written and oral examination. The oral examination shall be conducted
by and before the members of the Electrical License Board at a regular
meeting of such Board. The written examination shall be conducted
under the general supervision of a member of the Electrical Licensing
Board.
A.
The Board of Trustees shall appoint an Electrical
License Board consisting of five members, at least three of whom shall
have been master electricians for a period of not less than three
years. Such Board shall have the power to examine all applicants for
licenses and determine their fitness for a license under this chapter
and to recommend to the Board of Trustees that a license be issued
to each applicant who passes and qualifies at such examination.

B.
The Board of Trustees shall have the power to remove
any member of the Electrical License Board and shall fill any vacancy
therein. The members of the Electrical License Board shall receive
such compensation as shall be fixed by the Board of Trustees. The
members of the Electrical License Board shall each serve for a period
of three years, to commence at 12:00 noon on the first Monday in April
and to expire immediately before 12:00 noon on the first Monday in
April three years thereafter. Two members shall constitute a quorum
of the Electrical License Board for the transaction of business.

C.
The Electrical Inspector shall investigate any violations
that may be charged against any licensee hereunder and report the
result thereof to the Electrical License Board.
D.
The Electrical License Board shall hold a regular
meeting during each calendar month at 4:30 p.m. on the fourth Thursday
of each month.

E.
A special meeting may be held by the Electrical License
Board on at least 24 hours' notice at the call of the Chairman or
a majority of the members thereof, but no applications for licenses
shall be acted upon by the Board at such special meetings.

Charges. The biannual license renewal fee shall be $100. In the event
that the holder of a license does not apply for a renewal of the license
before the 31st day of January following the expiration of his license,
said license shall be deemed to have expired and may be renewed upon
payment of a fee of $150 if application for renewal is made within
one year from the date of expiration. Renewal applications made more
than one year after the date of expiration shall be treated as a new
application, which will require the Electrical Board's approval
to take a new exam.

B.
Failure to receive notice, bill. Failure to receive
notice of renewal or bill shall not relieve the licensee from the
provisions of this section and shall not constitute a waiver by the
Village of any of its rights or powers hereunder.
C.
The license renewal shall be submitted on business or company letterhead
with the applicant's current address and telephone number. A
partnership application can only be submitted by a partner of a partnership
or an officer of a corporation. If the applicant is a partnership
or a corporation, the current address and telephone number of each
partner or officer must be provided.

D.
The licensee seeking a license renewal must provide proof that the
licensee has completed eight hours of continuing education in the
New York State Electrical Code within six months prior to the license
renewal.

A.
A temporary certificate of completion may be issued by the Electrical Inspector for a period not to exceed 30 days if in his opinion such a certificate is necessary. If the certificate described in Subsection B below is not obtained within the thirty-day period, this temporary certificate shall automatically expire unless extended in writing by the Electrical Inspector.
B.
A certificate of completion and compliance may be
issued when the work has been performed and materials installed in
accordance with this chapter. Such certificate shall be issued only
to the applicant.

A.
Application for permission to perform electrical work
shall be filed by the applicant with the Electrical Inspector in the
form required by the Village Clerk. The person signing the application
shall be a master electrician duly licensed as required by this chapter.
B.
An electrical permit shall be considered authorization to commence
work in accordance with the approved application. Work shall commence
within 90 days of the date of issuance of the permit, unless the holder
of the permit submits a written explanation to the Building Department
that addresses the reason(s) for the delay; and the work authorized
in the permit shall be completed within one year of the issuance of
said permit or else the project shall be deemed abandoned.

C.
Whenever a project has been deemed abandoned, it shall
be unlawful to continue work thereon. However, if a written request
is filed outlining the reasons necessitating an extension of time,
the Electrical Inspector may, for good cause, allow reasonable extensions
of time to complete the project, which extension or extensions shall
be evidenced by a supplementary permit or permits.
D.
No supplementary permit shall be issued for a period
greater than 180 days, and in no event shall the completion period
be extended beyond two years from the date of issuance of the original
electrical permit.
E.
In the event that violations are issued during the course of the
work, the licensee shall be required to meet with the electrical inspector
at the job site; and in the event the licensee fails to do so, the
permit may be revoked.

Whenever a licensed master electrician or electrician
holding a limited license or his employer or any firm, association
or corporation performing work under this chapter shall change his,
their or its business address, retire from business, be dissolved
or change officers or places of residence, as the case may be, written
notice thereof shall be promptly given by mail to the Village Clerk,
and the new address and name or names of such licensee, employer and
new officers of any such corporation, change in membership or partnership
and addresses of partners shall be set forth therein.

A.
The Electrical Inspector may, at any time, require proof of the existence
of a partnership or corporation applying for a license, permit or
certificate under this chapter. Failure to submit such proof shall
justify the refusal of a license or any permit or certificate until
furnished.
B.
Joint ventures are prohibited unless both parties are licensed by
the Village of Hempstead.
C.
If a partnership or corporation has been issued a license, such entity
must immediately notify the Village Building Department of any changes
made of partners or officers.
