As provided in § 10 of the Municipal Home Rule Law, the following provisions of the Village Law are amended in their application to the Village of Wappingers Falls, as follows:
A. 
Subdivision 3 of § 3-301 is amended to read as follows:
3.
The Mayor, Trustees and Village Justices shall be elective offices. All other officers shall be appointed by the Board of Trustees.
B. 
Subdivision 5 of § 3-308 is amended to read as follows:
5.
The Board of Trustees shall appoint the members of any board of commissioners, and the first appointments of members thereto shall be for terms so fixed that at least one will expire at the end of each official year commencing at the end of the current such year and continuing in succeeding years until the entire original appointments run out. No such term shall exceed five years.
C. 
Subdivision 3 of § 3-312 is amended to read as follows:
3.
Vacancies in office caused other than by expiration of the terms thereof shall be filled by the Board of Trustees to the extent and for the periods of time set. forth herein.
a.
In appointive offices for the balance of unexpired terms;
b.
In elective offices as follows:
(1)
If such vacancy occurs more than 20 days prior to the third Tuesday of the month preceding the end of the current official year, for the balance of such year.
(2)
If such vacancy occurs 20 days or less prior to the third Tuesday of the month preceding the end of the current official year, for the balance of the year and, if the term of offices does not expire at the end of such year, by further appointments to the end of the next official year.
D. 
Subdivision 2 of § 7-712 of the Village Law is amended to read as follows:

Each Village Board of Trustees which adopts a local law and any amendments thereto pursuant to the powers granted by this article shall create a Board of Appeals consisting of three or five members as shall be determined by such local law. The Village Board of Trustees shall appoint the Board of Appeals and the Chairperson thereof. In the absence of a Chairperson, the Board of Appeals may designate a member to serve as Acting Chairperson. The Board of Trustees may provide for compensation to be paid to experts, clerks and a secretary and provide for such other expenses as may be necessary and proper, not exceeding the appropriation made by the Board of Trustees for such purpose. In making such appointments, the Village Board of Trustees may require Board of Appeals members to complete training and to continue education courses in accordance with any local requirements for the training of such members.
E. 
Subdivision 8 of § 7-712 is amended to read as follows:
8.
Vacancy in office. If a vacancy shall occur otherwise than by expiration of term, the Village Board of Trustees shall appoint a new member for the unexpired term.
F. 
Subdivision 9 of § 7-712 is amended to read as follows:
9.
Removal of members. The Board of Trustees shall have the power to remove, after public hearing, any member of the Zoning Board of Appeals for cause. Any Zoning Board of Appeals member may be removed or noncompliance with minimum requirements relating to meeting attendance and training as established by the Village Board of Trustees by local law.
G. 
Subdivision 11 of § 7-712 is amended to read as follows:
11.
Alternate members. The Village Board of Trustees may, by local law, or as a part of the local law creating the Zoning Board of Appeals, establish alternate Zoning Board of Appeals member positions for purposes of substituting for a member in the event that such member is unable to participate because of a conflict of interest. Alternate members of the Zoning Board of Appeals shall be appointed by the Village Board of Trustees for terms established by said Board of Trustees.
H. 
Subdivision 1 of § 7-718 is amended to read as follows:
1.
Authorization. The Village Board of Trustees of each village is hereby authorized by local law to create a Planning Board consisting of five or seven members. Members and the Chairperson of such Planning Board shall be appointed by the Village Board of Trustees. In the absence of a Chairperson, the Planning Board may designate a member to serve as Chairperson. The Village Board of Trustees may as part of the local law creating such Planning Board, provide for the compensation of Planning Board members. In making such appointments, the Village Board of Trustees may require Planning Board members to complete training and continuing education courses in accordance with any local requirements for the training of such members.

Subdivision 8 of § 7-718 is amended to read as follows:
8.
Vacancy in office. If a vacancy shall occur other than by expiration of term, the Village Board of Trustees shall appoint the new member for the unexpired term.
J. 
Subdivision 9 of § 7-718 is amended to read as follows:
9.
Removal of members. The Village Board of Trustees shall have the power to remove, after public hearing, any member of the Planning Board for cause. Any Planning Board member may be removed for noncompliance with minimum requirements relating to meeting attendance and training as established by the Village Board of Trustees by local law.
K. 
Subdivision 16 of § 7-718 is amended to read as follows:

Alternate members of the Planning Board shall be appointed by the Village Board of Trustees for terms established by said Board.

It is the intention of the Village Board of Trustees of the Village of Wappingers Falls that it modify the duration of the appointment of the position of Village Clerk. Said modification is done to create more stability in the position of Village Clerk and to attract the most qualified candidates to this position.
The position of Village Clerk shall hereinafter be a permanent position, not subject to an annual appointment. Furthermore, any and all persons appointed to the position of Village Clerk shall hereinafter be afforded all rights available to persons holding a position by permanent appointment in the competitive class of the classified civil service, pursuant to Article V, § 75, of the Civil Service Law of the State of New York.
With the exception of the duration of an appointment to the position of Village Clerk, no other portion of § 2-240 or 4-402 of the Village Law of the State of New York is effected by this article.
