The Village Board of the Village of Wappingers Falls is desirous of
regulating the operation of garage sales and yard sales within the geographical
boundaries of this village such that the same do not contribute or cause an
obstruction to pedestrian or vehicular traffic, an adverse effect on the surrounding
residential community or the circumvention of the Village Zoning Code by replacing
the residential character of our neighborhoods with that official enterprise.
As used in this chapter, the following terms shall have the meanings
indicated:
A plot, tract, premises or parcel of land, with or without buildings
or structures located thereon.
The offering for sale or the requesting of donations in exchange
for items of personal property by the occupants or owners of real property
in this village, and said property is not ordinarily used for and licensed
as a commercial retail establishment.
No person or persons shall conduct a yard sale or garage sale within
the Village of Wappingers Falls without first having obtained a permit issued
by the Village Clerk of the Village of Wappingers Falls for said purpose.
Every person convicted of violating this chapter shall, for a first
conviction thereof, be punished by a fine of not more than $250.
