This chapter shall be known as the "Mahoning Township Joint Emergency
Operations Plan Ordinance."
The Township of Mahoning hereby resolves to enter into an Intergovernmental
Cooperation Agreement with certain other townships and boroughs of Montour
County that have enacted a similar ordinance and such other municipalities
as would desire to enter into an Intergovernmental Agreement in the future,
whereby a Montour County Joint Emergency Operations Plan will be created.
The purpose of the County Emergency Operations Plan is to plan for and
respond to any natural or man-caused disaster emergencies that may occur within
the geographical boundaries of Montour County.
The conditions of the Intergovernmental Cooperation Agreement to be
entered into between the participating municipalities and the county are generally
as follows:
A. The municipalities agree that they shall take steps to
assure the formulation of the County Emergency Operations Plan, and they shall
adopt and declare the County Emergency Operations Plan to be the emergency
operations plan of each of their municipalities for the purpose of fulfilling
the requirement in Subsection 7503(1) of the Emergency Management Services
Code to prepare, maintain, and keep current a disaster emergency management
plan for each of their municipalities.
B. Each municipality agrees and shall provide necessary
information to the County Emergency Management Agency on a periodic basis,
as determined by the Coordinator of the Montour Emergency Management Agency
(hereafter referred to as the "Coordinator"), in order to prepare and maintain
a joint Emergency Operations Plan that can and will be implemented for response
to emergencies affecting the municipalities that are parties to this Agreement.
Each municipality agrees that the County Emergency Operations Plan shall constitute
the Joint Emergency Operations Plan of the municipalities.
C. Each municipality shall provide reimbursement to the
Montour County Emergency Management Agency for the printing and mailing of
the said Joint Emergency Operations Plan.
D. Each municipality agrees to use the Montour County Emergency
Operations Plan for a term of five years. At the end of this period of time,
any municipality may withdraw from this Agreement after providing: a) 30 days'
written notice to the other member municipalities; and b) acceptance by the
Montour County Emergency Management Coordinator of a standalone emergency
operations plan for that municipality. This Agreement, however, shall continue
to exist among the remaining municipalities.
A copy of this chapter shall be filed with the Montour County Emergency
Management Agency and shall remain in effect unless amended. Any amendments
shall also be filed with the Montour County Emergency Management Agency.
