It shall be unlawful for any person, firm, association
or corporation to erect, construct, alter, repair or extend any on-lot
sewage disposal system of any kind within the limits of the Borough
of New Salem, York County, Pennsylvania, unless a permit to do so
shall first be secured as provided herein.
All applications for permitting of on-lot sewage
systems shall be made to the Borough Sewage Enforcement Officer designated
by the Borough Council of the Borough of New Salem.
The Sewage Enforcement Officer shall issue a
permit upon compliance by the applicant with the provisions of the
Pennsylvania Sewage Facilities Act of January 24, 1966, P.L. 1535, as amended, and any regulations adopted thereunder.
Application for permits shall be in writing,
shall be signed by the applicant and shall be on the standard form
adopted or prescribed by the Department of Environmental Protection
of the Commonwealth of Pennsylvania.
The fees charged for any tests required for
the issuing of a permit, and for the application required herein,
shall be as established by the Borough Council of the Borough of New
Salem, and shall be paid by the applicant at the time of filing of
the application. Said fee shall not be refunded to the applicant in
the event that a permit is denied.
Any person, firm, association or corporation
violating any of the provisions of this article shall, upon conviction
thereof before the Magisterial District Judge, be fined a sum not
in excess of $1,000 for each and every offense. If a second prosecution
is filed as the result of a continuing violation, a defendant may
be sentenced up to 30 days in jail in addition to the fine and costs.
Also, in default of the payment of the fine and costs, the defendant
may be sentenced and committed to the York County Prison for a period
not exceeding 30 days. Each and every day that erection, construction,
alteration or extension continues without first securing a permit
in violation of the provisions hereof shall constitute a separate
and distinct offense and shall be subject to separate and distinct
penalties hereunder.
