The purpose of this chapter is to establish the process under which
building permits for demolition will be issued and, in particular, to provide
a means, when the proposed demolition involves a building more than 75 years
old, by which a delay in the issuance of a demolition permit up to a period
of 90 days may be effected.

No person shall demolish any building, structure or part thereof without
obtaining a building permit for demolition from the Building Official of the
Town. No person shall be eligible to receive a building permit for demolition
unless that person complies with the provisions of C.G.S. § 29-406
by providing to the Building Official written evidence:
A.
Of financial responsibility in the form of a certificate
of insurance specifying demolition purposes and providing liability coverage
for bodily injury of at least $100,000 per person with an aggregate of at
least $300,000 and for property damage of at least 50,000 per accident with
an aggregate of at least $100,000; each such certificate shall be accompanied
by a hold-harmless agreement under which the Town and its agents shall be
saved harmless from any claim or claims arising out of the negligence of the
applicant or his agents or employees in the course of the demolition operations.
B.
A certificate of notice executed by all public utilities
having service connections within the premises proposed to be demolished,
stating that such utilities have severed such connections and service.
C.
That the applicant is a holder of a current valid certificate
of registration issued under the provisions of C.G.S. § 29-402 unless
he falls within the exceptions of C.G.S. § 29-406.

If the building, structure or part thereof to be demolished is at least
500 square feet in size and 75 or more years old, the following additional
process shall be followed with respect to issuance of a building permit for
demolition:
A.
The Building Official shall arrange to have a legal notice
of such building permits for demolition application published in a daily or
weekly newspaper having a substantial circulation within the Town, which notice
shall be published within 15 days following the filing of the building permit
for demolition application. Such a legal notice shall include:
(1)
That a building permit for demolition application has
been filed for the demolition of a building, structure or part thereof which
is 75 or more years old.
(2)
The location of the property to be demolished.
(3)
The name of the owner of said property.
(4)
The date of the filing of the building permit for demolition
application.
(5)
That any objections to the proposed demolition shall
be submitted in writing to the Town's Building Official within a period of
30 days following the date of the publication of the legal notice.
(6)
That if no objections are filed within said thirty-day
period, the building permit for demolition may be issued.
B.
The Building Official, within 15 days following the filing of the building permit for demolition application, shall send, by first class mail, a copy of the legal notice required under Subsection A above to the following persons:
(1)
Property owners abutting the premises on which the building
to be demolished is located.
(2)
President, Farmington Historical Society.
(3)
Farmington Town Historian.
(4)
President, Farmington Land Trust.
(5)
President, Unionville Museum.
(6)
Chairman, Farmington Historic District Commission.
(7)
Commissioner, Connecticut Historical Commission.

If a written objection stating the nature of the objection is filed
with the Town Building Official within 30 days following publication of the
legal notice provided for above, the Building Official shall delay issuance
of the building permit for demolition for a total period of 90 days from the
date of receipt of the application. At the end of said ninety-day period,
the Building Official, if all requirements for a building permit for demolition
have been met, may issue a building permit for demolition.

This chapter is intended to supplement and not to limit any requirements
now or hereafter imposed by the Connecticut General Statutes and regulations
adopted thereunder or any authority now or hereafter granted to the Town Building
Official by the Connecticut Basic Building Code[1] with respect to the issuance of a demolition permit.
