A. 
All refuse stored outside of a building shall be kept in an appropriate container in accordance with the following:
(1) 
All trash shall be stored in a container or kept in a manner that prevents the scattering of such trash by natural conditions (wind, water, etc.) and by rodents, animals, birds and insects.
(2) 
All garbage shall be stored in a covered, watertight container that prevents access to the garbage by rodents, animals, birds or insects. Such container shall prevent the introduction of rainwater and shall be kept closed at all times, except when depositing garbage or when emptying its contents.
B. 
No accumulation of trash or garbage shall be permitted outside of the container.
All refuse shall be kept and stored in such a manner that no obnoxious or otherwise offensive odor such as constitutes a nuisance is detectable on any adjacent street or property owned by someone other than the person owning the property where the refuse is kept or stored. This prohibition shall also include the container for storing refuse.
This article shall not apply to refuse placed at the curb for collection on the day of collection.

A. 
Violations of the provisions of this article or permitting or authorizing any violation of this article shall be a civil offense pursuant to Chapter 126 of the Municipal Code of the City of Rehoboth Beach. Any person who violates this article shall pay a civil assessment of $100 fine. Whenever such person shall have been notified by the Building Inspector or in any other way that he or she is committing a violation of this article, each day he or she shall continue said violation thereafter shall constitute a separate offense punishable by like assessment.
B. 
In addition to the civil assessment herein described, the City may avail itself of any and all legal and equitable remedies for the purpose of stopping continuing violations of this article.
