For the purposes of this article, the following definitions shall be applicable unless the context clearly indicates to the contrary:
MOTORIZED SKATEBOARD OR SCOOTER
Any device that is designed to travel on one or more wheels with the deck or chassis of such device open and close to the ground, that may or may not handlebars or a hand-controlled throttle or brake, that is designed to be stood or sat upon by the operator, and that is powered by a motor that is capable of propelling the device without human propulsion. "Motorized skateboard or scooter" shall not include any automobile or device that is included within the definition of "moped," "motorcycle," off-highway vehicle (OHV)," any type of "tractor," "triped," "motorized wheelchair" or "electric personal assistive mobility device (EPAMD)" set forth in this chapter.

SCOOTER
A low, narrow footboard made out of wood or other material with a wheel or wheels at each end and a raised handlebar for steering and which can be propelled by foot or by a motor.
SKATEBOARD
A piece of wood or other material to which wheels are attached.
A. 
It shall be unlawful for any person to ride or operate any skateboard on and/or over any sidewalk adjoining any street, any street in the City of Rehoboth Beach from May 15 until September 15 of any year.
B. 
It shall be unlawful for any person to ride or operate any skateboard or scooter on and/or over the bandstand or any public structures throughout the entire year. The term "public structures" shall, in addition to its ordinary meaning, include but not be limited to the City's benches, plaques, memorials and steps.
C. 
It shall be unlawful for any person to ride or operate any skateboard on, under and/or over the Boardwalk or any of the Boardwalk pavilions throughout the entire year.
D. 
It shall be unlawful for any person to ride or operate any scooter on the following areas in the City of Rehoboth Beach from May 15 to September 15 of any year:
(1) 
The Boardwalk.
(2) 
Rehoboth Avenue, from Canal Bridge to the Boardwalk.

A. 
Motorized skateboards or scooters shall not be operated upon a public street or boardwalk or sidewalk or right-of-way thereof located within this City except under the following conditions:
(1) 
A motorized skateboard or scooter may be pushed across or along such public way provided such motorized skateboard or scooter is in neutral or that the power train is otherwise disengaged, and further provided that such use shall be in conformance with this chapter.
(2) 
A motorized skateboard or scooter may be operated on a street located within this City for a special event of limited duration, conducted according to a prearranged schedule only under permit from the City Manager.
B. 
A person shall not operate a motorized skateboard or scooter upon any property in either public or private ownership without the express permission of the person in control of the property or knowingly in violation of any restrictions imposed on such use by the person in control of the property.
A. 
Any person violating any of the provisions of this article shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined for the first offense not less than $15 nor more than $25, and for a second or subsequent offense shall be fined not less than $25 and shall pay the costs of prosecution.

B. 
For the purposes of this article, each day that a violation occurs shall be deemed to be a separate offense.
