A preapplication review of a proposed subdivision plan by Town staff
may be requested by an applicant in order to ascertain if the street layout
or any other proposal meets with the requirements of these regulations or
to ask for consideration of any variation of a requirement.

Application for subdivision approval shall be submitted by the applicant
on forms provided by the Commission. An application must be filed with the
Inland Wetlands Agency, where required, prior to filing an application for
subdivision approval.

Fees for subdivision and resubdivision applications shall be prescribed in §
177-50 of the West Hartford Code.

The Commission shall approve, modify or disapprove a final subdivision
plan within such period or periods of time as may be established by, or referenced
in C.G.S. § 8-26d, as that section may be amended or recodified
from time to time. The failure of the Commission to act thereon within said
period of time shall be considered as an approval, and a certificate to that
effect shall be issued by the Commission on demand, provided that an extension
of this period may be had with the consent of the applicant. The grounds for
disapproval shall be stated in the records of the Commission.

All final plans for subdivision shall, upon approval or when taken as
approved by reason of the failure of the Commission to act, be filed or recorded
in the office of the Town Clerk within 90 days of the date such plan is delivered
to the applicant. Any plan not so filed or recorded within the prescribed
time shall become null and void, except that the Commission may extend the
time for such filing for two additional periods of 90 days, and the plans
shall remain valid until the expiration of such extended time.
No final plan of subdivision shall be recorded or filed by the Town
Clerk or other officer duly authorized to record or file plans until approval
of the Commission has been endorsed thereon, and the filing or recording of
a subdivision plan without such approval shall be void.
The procedure for a resubdivision and the requirements for its application
are the same as for a normal subdivision, except that:
A. All plans of resubdivision shall include sufficient information
to enable the recorded original subdivision plan to be identified in the Town
records.
B. A public hearing, properly advertised, shall be held
for each resubdivision plan.
C. After such hearing, the Commission may approve, modify
or disapprove said application in accordance with the applicable provisions
of these regulations.
Before filing a bond with the Commission as provided in §
A184-10 of these regulations, the applicant shall submit to the Director of Community Services for approval a cost estimate for all required improvements to be covered by said bond, prepared by a professional civil engineer. The cost estimate shall be based on unit costs established by the Director of Community Services. Together with the filing of said bond with the Commission, the applicant shall submit, on forms provided by the Commission, two copies of the cost estimate as approved by the Director of Community Services.
These regulations supersede any previous regulations of the Town Plan
and Zoning Commission with respect to the submission of Town plan street layout
maps.
