Upon the occurrence of a vacancy in office of a Kent County Levy Court
Commissioner, and in the event the term of office remaining for said vacant
position is greater than six months, then the President of Levy Court shall
issue to the Kent County Department of Elections a Writ of Election designating
the time and place for the holding of a special election, which election date
shall be within six months of the occurrence of said vacancy.
Each party eligible to file a candidate for the vacant office may do
so by the Chairperson of the County Committee or, if there be none, the State
Chairperson of the party by filing with the Kent County Department of Elections,
on or before 30 days prior to the date set forth in the Writ of Election as
the date of the special election, a designated candidate.
To be an eligible candidate, the candidate must be a resident of the
district for which the special election is held, meet the requirements of
Article II, Section 21, of the Constitution of the State of Delaware and be
designated by a party that had state ballot status at the time of the preceding
general election.
To be eligible to vote in the special election, a voter must be a registered
voter within the district no later than 10 days prior to the date set forth
in the Writ of Election as the date of the special election.
The Director of the Kent County Department of Elections may adopt such
rules, regulations and/or procedures as are necessary to carry out the procedures
for holding the special election, which rules, regulations and procedures
shall not be inconsistent with this article nor Title 15 of the Delaware Code.
