The provisions of this chapter are severable, and if any of its provisions or any sentence, clause, or paragraph or part thereof, or the application thereof to any person or circumstance, shall be held unconstitutional or violative of the laws of the State of Delaware by any court of competent jurisdiction, the decision of such court shall not affect or impair any of the remaining provisions which can be given effect without the invalid provision or application.
This chapter constitutes a plan of subdivision and land development and all prior subdivision and land development design ordinances are hereby superseded and repealed. Notwithstanding the above, for subdivision applications vested before the effective date hereof, the prior enacted Chapter 187 of this Code shall remain in full force and effect.
This chapter shall be reviewed every five years from the date of adoption for consistency with the Kent County Comprehensive Plan and for general effectiveness in land use planning. This five-year review shall not be construed to mean the County cannot review and amend the chapter more frequently.
