Whenever, by this article or any other ordinance of this City, any parking time limit is imposed or parking is prohibited on designated streets, no such regulations shall be effective unless appropriate signs giving notice thereof are erected and in place at the time of any alleged offense, except that no such signs need be erected to make effective ordinances regulating the stopping, standing or parking of vehicles when these ordinances do not differ from the provisions of Act No. 300, Public Acts of 1949, as amended. Further, there shall be no requirement for the posting of signs prohibiting commercial vehicles from being parked or stored on residentially zoned property.

A. 
A commercial vehicle may be parked on any street in the City, subject to the following conditions:

(1) 
The vehicle is used solely as a commercial vehicle for business purposes.
(2) 
The driver of the vehicle is an occupant of the residential property where the vehicle is parked and is an employee of the business for which the vehicle is used for commercial purposes.
(3) 
The vehicle is that occupant’s principal means of transportation to and from the business where they are employed.
(4) 
The vehicle is not a stake truck (with or without stakes in place), a flatbed truck, a semitrailer-tractor or semitrailer, dump truck, tow truck (wrecker), car hauler, step van, ice cream truck, vendors truck, catering truck, cube van, or trailer, regardless of size, whether attached or unattached, that is used for the storage of tools, boats, vehicles, equipment, machinery, merchandise, inventory, supplies, or waste by-products, including, but not limited to, leaves, clippings, paper and/or building materials.
(5) 
The vehicle does not:
(a) 
Exceed 10,500 pounds; nor
(b) 
Exceed eight feet in height measured from the surface of the driveway under the vehicle to the highest roofline of the vehicle.
B. 
The Chief of Police or his/her designee, for good cause, may grant special parking permits permitting additional parking of commercial vehicles during the above hours, provided that each permit is granted for a definite period of time.

In any proceeding for violation of this article where a motor vehicle displays a commercial license registration plate, such registration shall constitute a prima facie presumption that it is a commercial vehicle at the time of any alleged violation. In any proceeding for violation of the weight-limitation provisions of this article, the indicated weight on the vehicle's registration shall constitute a prima facie presumption of the weight of the vehicle at the time of any alleged violation, and any gross vehicle weight classification indicated on the vehicle's registration or plate shall constitute a prima facie presumption that the weight of the vehicle was within such classification at the time of any alleged violation.
This article shall not become effective until such signs as are required by the Michigan State Motor Vehicle Code are posted at the appropriate places on highways at the corporate limits of the City, indicating that the parking of commercial vehicles is limited to 30 minutes between 2:00 a.m. and 7:00 a.m.

Violation of this article shall be punished as provided in Chapter 1, General Provisions, Article I.
