Positions within the classified service of the Township of Burlington to be filled by promotion, transfer or of a temporary nature shall be filled in accordance with the procedures set forth below.
A. 
Appointment. Where a need exists to fill a position by a temporary appointment, the appointing authority shall have the right to fill the position in accordance with the following procedure.
B. 
Civil service clearance. The appointing authority shall notify the Department of Civil Service of the probable length of time the position will continue. If practicable, the Department of Civil Service may authorize the temporary appointment to the position by certification of those eligible persons interested in a temporary appointment.
C. 
No certified eligibles. In the event there are no certified eligibles, as determined by the Department of Civil Service, the appointing authority may appoint any qualified person to the position, giving first preference to permanent employees of the Township of Burlington.
D. 
Acceptance or refusal of temporary appointment. The acceptance or refusal of a temporary appointment by a person whose name is on an eligible list shall not affect his rights to certification for permanent appointment, nor shall the temporary appointment confer upon the appointee any right of permanent appointment.
E. 
Renewal of temporary appointment. No temporary appointment shall extend beyond four months. Should a temporary position not be terminated at the expiration of such respective periods, the position shall be considered a permanent position and the Department of Civil Service shall act to fill such position in accordance with the rules concerning permanent positions.
The appointing authority may cause any employee within the Township of Burlington to be transferred or reassigned in accordance with N.J.A.C. 4:1-15.1 et seq.
A. 
Procedure. The appointing authority shall, for those positions other than those defined by the Department of Civil Service as entrance-level positions or for which there are no qualified employees in a lower classification, fill these positions by way of promotion of employees of the Township of Burlington and shall follow the same procedures outlined in Article VII of this chapter, except as may be modified below.[1]

B. 
Competitive examination. Whenever an examination is to be held to promulgate an employment list, the Department of Civil Service, after receiving the recommendations of the appointing authority, shall determine whether a promotional examination shall be held, except that, insofar as it is consistent with the best interests of the service, vacancies shall be filled by promotion of permanent employees based on competitive examinations which shall include an evaluation of records of service and such other tests or measures of fitness as may be necessary.
C. 
Promotion upon waiver of competitive examination.
(1) 
The President of the Civil Service Commission may authorize the promotion of a qualified permanent employee by regular appointment and without a competitive examination, provided all of the following conditions are met:
(a) 
The employee has previously taken and passed an examination for the basic skills required in the position to which the promotion is to be made;
(b) 
The employee has not, within three years previous to the announced closing date for filling applications, failed to pass a promotional examination for the position to which the promotion is to be made, but if the employee shall have passed subsequently an examination for the position, he shall be eligible notwithstanding the earlier failure;
(c) 
The employee is serving under a provisional appointment in the class or position to which the promotion is to be effected;
(d) 
Not more than three eligible employees file applications to take such test when only one promotional appointment is to be made, or when more than one promotional appointment is to be made, the number of eligible employees who file applications to take the examination does not exceed by more than two the number of promotional appointments to be made; or
(e) 
Preference rights of veterans will not be affected.
D. 
Qualifications for promotional examinations.
(1) 
In order to qualify for promotional examination, an applicant:
(a) 
Must meet all the qualifications of N.J.A.C. 4:1-8.8, except that the residency requirement shall not be applicable unless required by law;
(b) 
Must be a permanent employee in a class to which the examination is opened by the announced closing date for filing applications and, unless otherwise provided by regulation, shall have been employed in such lower class for at least one year after regular appointment;
(c) 
Must be in active employment in a class designated by the Chief Examiner and Secretary on the announced closing date for filing application and remain until the employment list is issued, except that absence from such active employment shall not disqualify an applicant otherwise qualified, who:

Is on an approved leave with pay;
[2] 
Is on military leave;
[3] 
Is on a temporary assignment or temporary transfer within the same or to a different organization unit, as the case may be;
[4] 
Is on educational leave;
[5] 
Is assigned or detailed to another governmental unit pursuant to any federal or state employee interchange act; or
[6] 
Is promoted to another class title in the same organization unit.
