A. 
The appointing authority shall submit payrolls, accounts or other claims for payment for personal service to the Department of Civil Service at the times and in the form required by the Department of Civil Service.
B. 
Bills, vouchers, warrants or claims for personal service may not be honored for payment until such payment has been approved by the Department of Civil Service. All such items must be entered on a payroll as prescribed by regulation.
Each payroll shall be certified by the Administrator and/or Payroll Clerk, and the name, title and signature of any such officer shall have been placed on file with the Department of Civil Service prior to the submission of any payroll containing his name as certifying officer.

No disbursing or auditing officer shall make or approve any payment to any person holding a position in the classified service unless the Chief Examiner and Secretary or his authorized agent has approved and notified the appointing authority that the person named has been appointed and employed and has been or is performing service in accordance with the Civil Service Law and rules, except where preliminary approval has been otherwise provided for by regulation.
B. 
The Chief Examiner and Secretary or his authorized agent may withhold approval of an entire payroll or any specific item of a payroll if he finds that any person thereon has been appointed, employed and has been or is performing services contrary to any provisions of the Civil Service Law, rules or regulations.
(1) 
An employee being paid at a salary rate above the range for his class title unless otherwise provided for by the Civil Service Commission or the Salary Adjustment Commission shall be considered to be functioning contrary to the provisions of the Civil Service Law and rules. The Chief Examiner and Secretary shall withhold approval of the pay of any such employee;
(2) 
When there has been no positive action on the part of the appointing authority to correct the payroll items which has been disapproved, the matter shall be referred to the Attorney General's Office for appropriate action to obtain compliance.

The appointing authority shall certify to the disbursing or fiscal officer that the persons to be paid for the current payroll period have been given the approval of the Chief Examiner and Secretary or his authorized agent, except in those situations as otherwise provided by regulation.
B. 
The responsibility for having paid an employee illegally shall rest with the appointing authority.
A. 
An employee who is entitled to have his pay certified may institute legal proceedings to compel such certification and payment.
B. 
A person employed or appointed contrary to civil service provisions. who is thereby denied civil service approval of payment for services rendered, may maintain an action against the officer who purported to employ him to recover the actual value of his services. No officer shall be reimbursed for sums so paid or recovered.
Any citizen taxpayer may maintain an action to recover moneys paid contrary to the provisions of the Civil Service Law or rules. Moneys recovered shall be paid to the Treasury, except that the plaintiff shall be entitled to receive such portion as prescribed by law.
