There is hereby adopted by the Township of Burlington the fire control measures and regulations as herein set forth for the purposes of controlling conditions which could impede or interfere with fire-suppression forces.

The Fire Official or, in the absence of the Fire Official, the officer in charge who is charged with the duty of supervising or directing operations at the scene of any fire shall be the sole authority within fire lines established by said Fire Official or officer in charge. At the scene of any fire with respect to all fire-fighting operations relating to the protection of life and property endangered by such fire, and within said fire lines, the authority of the Fire Official or officer in charge shall supersede that of any municipal police authority. The authority hereby invested in the Fire Official or officer in charge shall terminate at such time as the fire is declared extinguished. Nothing in this article shall affect the responsibilities and powers of the Municipal Emergency Management Coordinator during a declared emergency.

It shall be unlawful to interfere with, attempt to interfere with, conspire to interfere with, obstruct or restrict the mobility of, or block the path of travel of any Fire District emergency vehicle in any way, or to interfere with, attempt to interfere with, conspire to interfere with, obstruct or hamper any Fire District operation.
A person shall not willfully fail or refuse to comply with any lawful order or direction of the Fire Official or to interfere with the compliance attempts of another individual.

A vehicle shall not be driven or propelled over any unprotected fire hose of the Fire District when laid down on any street, alleyway, private drive or any other vehicular roadway without the consent of the Fire Official in command of said operation.
Authorized emergency vehicles shall be restricted to those which are defined and authorized under the laws of the State of New Jersey.
Upon the approach of any authorized emergency vehicle giving audible and visual signal, the operator of every other vehicle shall immediately drive the same to a position as near as possible and parallel to the right-hand edge or curb of the street or roadway, clear of any intersection, and shall stop and remain in such position until the authorized emergency vehicle or vehicles shall have passed, unless otherwise directed by the Fire Official or a police officer.
It shall be unlawful for the operator of any vehicle, other than one on official business, to follow closer than 300 feet from any fire apparatus traveling in response to a fire alarm, or to drive any vehicle within the block or immediate area where fire apparatus has stopped in answer to a fire alarm.

A person shall not, without proper authorization from the Fire Official in charge of said Fire District emergency equipment, cling to, attach himself to, climb upon or into, board or swing upon any Fire District emergency vehicle, whether the same is in motion or at rest, or sound the siren, horn, bell or other sound-producing device thereon, or to manipulate or tamper with, or attempt to manipulate or tamper with any levers, valves, switches, starting devices, brakes, pumps or any equipment or protective clothing on or a part of any Fire District emergency vehicle.

It shall be unlawful for any person to damage or deface or attempt or conspire to damage or deface any Fire District emergency vehicle at any time, or to injure or attempt to injure or conspire to injure Fire District personnel while performing district duties.
The driver of any emergency vehicle, as defined in § 275-6 of this article, shall not sound the siren thereon or have the front red lights on or disobey any existing traffic regulations except when said vehicle is responding to an emergency call or when responding to, but not upon returning from, a fire. Tactical strategies, such as, but not restricted to, "move-ups" do not constitute an emergency call. The driver of an emergency vehicle may:
A. 
Park or stand, irrespective of the provisions of existing traffic regulations.
B. 
Proceed past a red or stop signal or other sign, but only after slowing down as may be necessary for safe operation.
C. 
Exceed the prima facie speed limit so long as he does not endanger life or property.
D. 
Disregard regulations governing direction of movement or turning in specified directions.
E. 
The exemptions herein granted to an emergency vehicle shall apply only when the driver of any such vehicle while in motion sounds audible signal by bell, siren or exhaust whistle as may be reasonably necessary and when the vehicle is equipped with at least one lighted lamp displaying a red light visible under normal atmospheric conditions from a distance of 500 feet to the front of such vehicle.
A. 
It shall be unlawful to obscure from view, damage, deface, obstruct or restrict the access to any fire hydrant or any Fire District connection for the pressurization of fire-suppression systems, including fire hydrants and Fire District connections that are located on public or private streets and access lanes or on private property.

B. 
If upon the expiration of the time mentioned in a notice of violation obstructions or encroachments are not removed, the Fire Official shall proceed to remove the same. Cost incurred in the performance of necessary work shall be paid from the Municipal Treasury on certificate of the Fire Official and with the approval of the chief administrative official, and the legal authority of the municipality shall institute appropriate action for the recovery of such costs.

A person shall not use or operate any fire hydrant intended for use of the Fire District for fire-suppression purposes unless such person first secures a permit for such use from the Fire Official and the water company having jurisdiction. This section shall not apply to the use of such hydrants by a person employed by, and authorized to make such use by, the water company having jurisdiction.
The Fire Official shall recommend to the chief administrative official of the municipality the location or relocation of new or existing fire hydrants and the placement or replacement of inadequate water mains located upon public property and deemed necessary to provide an adequate fire flow and distribution pattern. A fire hydrant shall not be placed into or removed from service until approved by the Fire Official.
All new and existing shipyards, oil storage plants, lumberyards, amusement or exhibition parks, and educational or institutional complexes and similar occupancies and uses involving high fire or life hazards and which are located more than 150 feet from a public street or which require quantities of water beyond the capabilities of the public water distribution system shall be provided with properly placed fire hydrants. Such fire hydrants shall be capable of supplying fire flows as required by the Fire Official and shall be connected to a water system in accordance with accepted engineering practices. The Fire Official shall designate and approve the number and location of fire hydrants. The Fire Official may require the installation of sufficient fire hose and equipment housed in accordance with the approved rules and may require the establishment of a trained fire brigade when the hazard involved requires such measures. Private hydrants shall not be placed into or removed from service until approved by the Fire Official.
A person shall not obstruct, remove, tamper with or otherwise disturb any fire hydrant or fire appliance required to be installed or maintained under the provisions of the Fire Prevention Code except for the purpose of extinguishing fire, training or testing purposes, recharging or making necessary repairs, or when permitted by the Fire Official. Whenever a fire appliance is removed as herein permitted, it shall be replaced or reinstalled as soon as the purpose for which it was removed has been accomplished. Defective and nonapproved fire appliances or equipment shall be replaced or repaired as directed by the Fire Official.
A person shall not sell, trade, loan or give away any form, type or kind of fire extinguisher which is not approved by the Fire Official, or which is not in proper working order, or the contents of which do not meet the requirements of the Fire Official. The requirements of this section shall not apply to the sale, trade or exchange of obsolete or damaged equipment for junk and said units are permanently disfigured or marked with permanent signs identifying the units as junk.

No person shall erect, construct, place or maintain any type of obstruction in or on any street or right-of-way within the boundaries of the municipality. It is also unlawful to obstruct or to permit or maintain the growth or accumulation of any weeds, grasses, shrubs, bushes or other material obstructing the highways, streets, or alleys of said Township except on collection day. The word “streets,” as used in this article, shall mean any roadway or Township right-of-way accessible to the public for vehicular and pedestrian traffic, including, but not limited to, private streets or access lanes, as well as all public streets and highways within the boundaries of the municipality.

This article shall be known as "The Fire Prevention Code of Burlington Township."
The New Jersey Uniform Fire Code, N.J.A.C. 5:70-1 et seq., and all amendments and supplements thereto, is hereby adopted by the Township for the purpose of establishing a system for the enforcement of minimum firesafety standards throughout the Township, as mandated by the State of New Jersey, so as to improve the safety of the public by promoting the control of fire hazards. The standards, rules and regulations set forth in the code shall be and the same are hereby incorporated in this chapter, three copies of which have been and are now on file in the office of the Township Clerk.
Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383), this article shall be enforced by the Commissioners of Fire District No. 1 of the Township of Burlington, County of Burlington and State of New Jersey (hereinafter known as "Commissioners") through the Bureau of Fire Prevention. The Bureau of Fire Prevention shall enforce the Uniform Fire Code and regulations adopted under it in all buildings, structures and premises within the Township of Burlington, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Code. In addition, the Bureau of Fire Prevention shall be charged with duties of enforcement of such other ordinances and rules and regulations that pertain to fire prevention and control. The Bureau of Fire Prevention shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs. Said Bureau shall be under the supervision and control of the Fire Official, who shall report to the Commissioners of Fire District No. 1. Such funds as may be necessary to support the operation of the Bureau shall be raised by the Commissioners in the manner prescribed by law. Pursuant to the Uniform Fire Code, the Bureau shall be operated by a Fire Official having the minimum qualifications and certifications set forth under the Uniform Fire Code. The salary of the Fire Official, Fire Inspectors and other personnel employed by the Bureau shall be, to the extent permitted by law, established by the Commissioners. The annual budget for the operation of the Bureau of Fire Prevention shall be established by the Commissioners. The Commissioners shall have the authority to appoint, promote and terminate personnel within the Bureau, subject to N.J.S.A. 11A:1 et seq.,[1] and N.J.S.A. 40A:14-81.1.

The Division of Fire Safety and the Department of Community Affairs of the State of New Jersey is hereby designated as the agency for the collection of the annual registration fees associated with life-hazard uses as set forth in the New Jersey Uniform Fire Code. The annual registration fee for life-hazard uses shall be established in the Uniform Fire Code. All the fees, permits and penalties assessed pursuant to this article and/or the Uniform Fire Code shall be collected by the Burlington Township Bureau of Fire Prevention.
All penalties under the Uniform Fire Code (N.J.A.C. 5:18-2) shall be adopted for the purpose of enforcing this article against any person or persons, firm, partnership or corporation violating any of the provisions of this article. The appeal process set forth in the New Jersey Administrative Code shall be adopted by this article.
A. 
In addition to the inspections and fees required pursuant to the Uniform Fire Safety Act and the regulations of the State of New Jersey, Department of Community Affairs, the following firesafety inspections, permits and fees shall be required, none of which will apply to fees or inspections of life-hazard uses as governed by the Uniform Fire Safety Act, unless such uses are to be inspected more frequently than required by the Act.
B. 
The following buildings, uses and premises contained in this section constitute firesafety uses other than life-hazard uses, which are subject to registration and periodic inspection requirements established by the article. Where two or more firesafety uses exist at the same building or premises, each one shall be considered as separate and distinct for the purposes of the Code and shall be registered pursuant to the provisions of this article.
(1) 
Enumeration of uses.
(a) 
Firesafety Use Group A, Assembly.

Generally. All buildings and structures, or parts thereof, shall be classified in Use Group A which are used or designed for places of assembly as defined in this article.
[a] 
Firesafety Use Group A-1 structures: (Reserved).
[b] 
Firesafety Use Group A-2 structures: (Reserved).
[c] 
Firesafety Use Group A-3 structures: This use group shall include all buildings in which persons assemble, such as libraries and restaurants, other than life-hazard uses.
[d] 
Firesafety Use Group A-4 structures: This use group shall include all buildings used as churches and for similar religious purposes.
(b) 
Firesafety Use Group B, Business.
[1] 
Generally. All buildings and structures, or parts thereof, shall be classified in Firesafety Use Group B which are used for the transaction of business, for the rendering of professional services, or for other services that involve stocks of goods, wares or merchandise in limited quantities for use incidental to office uses or sample purposes.
[a] 
Firesafety Use Group B-1A: This use group shall include all business establishments having a gross floor area of less than 250 square feet.
[b] 
Firesafety Use Group B-1B: This use group shall include all business establishments having a gross floor area of 250 square feet or more, but less than 3,400 square feet.
[c] 
Firesafety Use Group B-2: This use group shall include all business establishments having a gross floor area of 3,500 square feet or more, but less than 12,000 square feet.
[d] 
Firesafety Use Group B-2A: This use group shall include all business establishments having a gross floor area of 12,000 square feet or more, but less than 24,000 square feet.
[e] 
Firesafety Use Group B-2B: This use group shall include all business establishments having a gross floor area of 24,000 square feet or more, but less than 48,000 square feet.
[f] 
Firesafety Use Group B-2C: This use group shall include all business establishments having a gross floor area of 48,000 square feet or more.
[g] 
Firesafety Use Group B-3: multiple business occupancy. This use group shall include all buildings and structures, or parts thereof, which are used for the purposes that meet the requirements of Use Group B and which comprise a multiplicity of rooms, suites or areas to accommodate multiple business occupancies, not to exceed 30 in number, which are rented from a common owner. The building owner, who shall control access to all areas, shall provide basic services as are needed for the tenants to conduct their businesses, at their option. These services may include, but are not limited to, clerical, phone answering and message taking, photocopying and reproduction, mail services, security and secretarial and stenographers.

List of business uses. The uses listed in Table B are indicative of but not exclusive of and shall be classified as Firesafety Use Group B.

Firesafety Use Group H, High Hazard. Generally: All buildings and structures or parts thereof shall be classified in Firesafety Use Group H which are used for the manufacturing, processing, generation or storage of corrosive, highly toxic materials or poisonous gas that may constitute a high fire or explosion hazard, including loose combustible fibers, dust and unstable materials.
(f) 
Firesafety Use Group I, Institutional. Generally: All buildings and structures, or parts thereof, shall be classified in Firesafety Use Group I in which people suffering from physical limitations because of health or age are harbored for medical or other care or treatment.

Firesafety Use Group I-1: This group shall include buildings housing individuals who, because of age, mental instability or other reasons, must live in a supervised environment but who are physically capable of responding to an emergency situation without personal assistance. Included in this group are uses such as facilities for children, aged persons, mentally impaired and convalescents, including convalescent facilities, group homes, mentally retarded care facilities, nursing homes (ambulatory), orphanages and residential care facilities which are not classified as life-hazard uses under the Uniform Fire Code.
(g) 
Firesafety Use Group M, Mercantile. Generally: All buildings and structures or parts thereof shall be classified in Firesafety Use Group M which are used for display and sales purposes involving stocks of goods, wares or merchandise incidental to such purposes and accessible to the public, including among others retail stores, shops and salesrooms and markets. Highly combustible goods shall be limited to small quantities that do not constitute a high hazard.

Firesafety Use Group M-1A: This use group shall include mercantile establishments having a gross floor area of less than 250 square feet.
[2] 
Firesafety Use Group M-1B: This use group shall include mercantile establishments having a gross floor area of 250 square feet or more, but less than 3,500 square feet.

Firesafety Use Group M-2: This use group shall include mercantile establishments having a gross floor area of 3,500 square feet or more, but less than 12,000 square feet.
(h) 
Firesafety Use Group R, Residential.

Generally. All buildings and structures or parts thereof shall be classified in Firesafety Use Group R in which families or households live, or in which sleeping accommodations are provided for individuals with or without dining facilities, excluding those that are classified as institutional buildings.

Firesafety Use Group R-2 structures: This use group shall include all multiple-family dwellings having two or three dwelling units, except for two-family dwellings in which one is occupied by the holder of the title to the property.

Buildings and structures of an accessory character and miscellaneous structures not classified in any specific use group shall be equipped and maintained to meet the requirements of the code commensurate with the fire and life hazard incidental to their use. Utility and miscellaneous uses shall include tanks, cooling towers, sheds and agricultural buildings.
(k) 
Firesafety Use Group V, Vacant Buildings. All structures or portions thereof vacant or unoccupied for a period of 90 days and not under active renovation, modification or construction shall be classified as Firesafety Use V.
(l) 
Doubtful firesafety use classifications: When a building or structure is not specifically provided for in this article or the classification of which is doubtful, such building or structure shall be included in the firesafety use group which it most nearly resembles in respect to the existing life and fire hazard, and it shall be so classified by the Fire Official.
(2)

Nonprofit organizations must acquire a permit but would be fee-exempt except for an administrative charge of $100 on a yearly basis.

All firesafety uses shall be inspected in accordance with Schedule A for compliance with the provisions of the Uniform Fire Code. Where, in the opinion of the Fire Official, there exists a condition liable to cause fire, contribute to the spread of fire, interfere with the fire-fighting operations, endanger life or violations of the provisions or intent of said code, inspections may be made as often as necessary for the purposes of ascertaining these conditions and causing them to be corrected.
