The office of Housing Code Official of the Borough of Eatontown is hereby created and shall be hereby designated as the Housing Code Official of the Borough of Eatontown and the appointee to the said office shall be designated as a Housing Code Official and shall be the Chief Administrator of the Division of Housing Code Enforcement and shall be part of the Department of Construction and Code Enforcement as established by Chapter
20 of the Code of the Borough of Eatontown.
The Housing Code Official shall be appointed
by majority vote of the governing body and shall hold office until
December 31 of the year of said appointment. Any vacancy in said office
shall be filled by the governing body for the unexpired portion of
such term. The Housing Code Official shall be chosen by the governing
body solely on the basis of his qualifications with special reference
to his actual training and/or experience in the field of housing construction,
maintenance and inspection and his familiarity with the statutes,
codes, ordinances and resolutions of the State of New Jersey and the
Borough of Eatontown governing the same. More particularly, in addition
to those criteria set forth above, the appointed Housing Code Official
must meet the standards set forth by the New Jersey Administrative
Code and the rules and regulations set forth and adopted by the Department
of Community Affairs, in particular, the following qualifications:
A. The appointed Housing Code Official must have at least
four years of full-time experience in the construction industry including
enforcement, or two years as a licensed inspector of multiple dwellings
upon completing all course requirements required of a Housing Code
Official.
B. Successful completion of an approved sixty-hour course
for Housing Code Officials.
C. Participation in an approved continuing education
program for Housing Code Officials by taking two courses within the
three-year cycle, one of which must be administrative and one technical.
D. An individual who possesses an associates or bachelor's
degree in engineering, code enforcement or other related disciplines
is exempt from the course requirements and can substitute education
for experience on a year-for-year basis.
E. The Housing Code Official must be licensed with the
Bureau of Code Services in the State of New Jersey.
The salary of the Housing Code Official shall
be established by an ordinance heretofore adopted and entitled "An
Ordinance Establishing and Providing for Salaries and Compensation
for Officials and Employees of the Borough of Eatontown, County of
Monmouth, Revision 1971," as amended and supplemented.
The Housing Code Official shall be responsible
to the governing body for the proper administration of his office,
and to that end, he shall be responsible for the implementation and
enforcement of:
A. The Hotel and Multiple Dwelling Health and Safety
Law, P.L. 1967, c. 76, and the State-Local Cooperative Housing Inspection Program
as they are applicable to the Borough of Eatontown, County of Monmouth.
B. An Ordinance Providing for the Inspection of Rooms,
Dwellings, Apartments Offered for Rent in the Borough of Eatontown,
County of Monmouth, State of New Jersey, Providing for Certificates
of Occupancy Therefor and Fixing Penalties for the Violation Thereof.
C. Such other statutes, ordinances, resolutions and the like of the State of New Jersey and the Borough of Eatontown as applicable to Subsections
A and
B of this section.
Nothing herein contained shall derogate from
or authorize the Housing Code Official of the Borough of Eatontown
to exercise the powers and duties of any elected official of the Borough
of Eatontown and the boards, bodies and commissions thereof established
pursuant to law.
This article shall take effect upon adoption
and publication.
