A.
Consistent
with N.J.S.A. 40:12-1 et seq., there is hereby created a Board of
Recreation Commissioners consisting of seven members and up to four
alternate members who will be appointed by the Mayor with the consent
of the majority of the members of the Harrison Township Committee.
At least one member shall be an active member of the Harrison Township
Committee. At least one member, but not more than two, shall be an
active member of the Parks and Open Space Advisory Committee. All
members of said Board shall be residents of the Township of Harrison,
except for two members who may be nonresidents. No Commissioner shall
receive any compensation for his/her service, except for the Secretary
of the Board who shall be paid according to the Harrison Township
Salary Ordinance.[1] The officers of the Commission shall be as follows: Chairman,
Vice Chairman and Secretary.

B.
Alternate
members shall be designated at the time of appointment as "Alternate
No. 1," "Alternate No. 2," "Alternate No. 3" and "Alternate No. 4."
Alternate members may participate in discussions of the proceedings
but may not vote except in the absence or disqualification of a regular
member. A vote shall not be delayed in order that a regular member
may vote instead of an alternate member. In the event a choice must
be made as to which alternate member is to vote, Alternate No. 1 shall
vote.
A.
PARK
RECREATION COMMISSIONERS
TOWNSHIP
For
the purpose of this chapter, the following words and phrases, unless
otherwise indicated, shall be deemed to have the following meanings:
An area of land, with or without water, developed and used
for public recreational purposes, including community center; landscaped
tracts; picnic grounds; playgrounds; athletic fields; recreation centers;
camps; foot, bicycle and bridle paths; motor vehicle drives; wildlife
sanctuaries; museums; zoological and botanical gardens; and facilities
for bathing, boating, hunting and fishing, as well as other recreational
facilities for the use and benefit of the public.
The Board of Recreation Commissioners is hereby created.
The Township of Harrison.
B.
Word
usage. "May" shall be construed to be permissive; "shall" shall be
construed to be mandatory.

In accordance with N.J.S.A. 40:12-1 et seq., the Commissioners
first appointed shall be appointed for terms of one, two, three, four
and five years, respectively, in such manner that the term of at least
one Commissioner, and not more than two Commissioners, shall expire
in each year according to the number appointed. Thereafter, all appointments
shall be for the term of five years, except Township Committee members,
who shall serve for a one-year term. Alternate members shall serve
two-year terms, and their expiration dates shall be staggered such
that two alternate members can be appointed each year. Members of
the Board may be removed at any time, for sufficient cause, by the
Mayor with the consent of the majority of the members of the Township
Committee. In the event of a vacancy caused by the death, inability,
resignation or removal of any member, the Mayor, with the approval
of the majority of the members of the Harrison Township Committee,
shall appoint another person to fill the unexpired term of such vacancy
from a list of names submitted by the Board.
Immediately following their appointment, an organizational meeting
shall be held by the members of the Recreation Committee, at which
time there shall be elected a Chairman.
The powers and duties of such Chairman shall be as follows:
A.
To
preside over all meetings of the Recreation Commission.
B.
To
appoint a Vice Chairman and recording secretary and an Acting Chairman
in the event of the nonavailability of the Chairman or Vice Chairman.
C.
To
appoint such subcommittees as may be authorized by the Recreation
Commission to carry out the objectives and purposes of the Recreation
Commission.
D.
To
certify to the Township Treasurer all expenditures of the Recreation
Commission.
A.
The
Recreation Commission thus constituted shall have all the powers and
duties provided by the laws of the State of New Jersey relating to
recreation commissioners of municipalities (N.J.S.A. 40:12-1 et seq.),
subject to the provisions of this chapter.
B.
The
Recreation Commission shall have the power to conduct any form of
recreation, celebratory and/or cultural activity that will benefit
the health, education and general welfare of the residents of this
Township.
C.
The
Recreation Commission may also solicit or receive any gifts, bequests
of money or other real or personal property to be applied for improvement
of parks, or other recreational facilities, or purchase of equipment
for same, and/or for recreation, cultural and/or celebratory activities.
D.
Powers
of said Recreation Commission include the authority to grant concessions
and privileges upon such conditions and for such compensation as it
shall prescribe. Any revenue received shall be used for the purposes
described in this chapter, provided that no concession or privilege
shall ever be granted for the sale of any intoxicating liquors, beer
and/or wine on any public park or property, and that no concession
or privilege shall be granted for a period of more than one year unless
approved by ordinance.
E.
The
Recreation Commission shall have no power to acquire, develop, regulate,
improve or manage land or real property. Any property held hereunder
shall be in the name of Harrison Township.
A.
In
order to provide the funds, in whole or in part, necessary to further
its activities, improve, and maintain the playgrounds or recreation
places, or purchase equipment for same, the Recreation Commission
may arrange and provide for the giving of outdoor exhibitions, concerts,
games, contests, parades and other celebratory activities, and may
use and employ the Township's playgrounds or recreation places,
when available, for such purposes.
B.
The
said Recreation Commission may charge and collect reasonable fees
from each person or group participating in the outdoor exhibitions,
concerts, games, contests, parades and other celebratory activities
or events.
C.
All
money received by the Recreation Commission shall be paid over to
the Harrison Township Treasurer and be kept by him or her in a special
fund, which shall be under the control of the Recreation Commission
and used only for the purpose of defraying the expenses of improving
or maintaining the playgrounds and recreation places; the activities
under the control of the Recreation Commission; and for any other
expenses of the Recreation Commission.
Annually, the Recreation Commission shall submit a budget to
the Township Committee on or before the second Monday in December
for its approval.
Regular meetings of the Recreation Commission shall be held
the third Tuesday of each month, or at the call of the Chairman or,
in his absence or disability, at the call of the Vice Chairman. At
all meetings a quorum shall consist of a majority of the members of
the Recreation Commission.
