There is hereby created and established by virtue of the provisions of this chapter a sewer utility within the Township of Harrison, in the County of Gloucester, to be known as the "Harrison Township Sewer Utility."
The Sewer Utility shall be publicly owned, and it shall for the purpose of accounting be considered a separate entity having its own separate borrowing capacity, its own separate property, both real and personal, and its own separate books and accounts, but shall be subject to and governed by rules, resolutions and ordinances adopted by the Township Committee of the Township of Harrison.
It shall be the function and duty of the Sewer Utility and it shall have authority to operate all sewer facilities, including but not limited to disposal plants, lines and equipment, used in connection with the collection, handling, treatment and disposal of sewerage in and for the Township of Harrison. It shall for the purpose of performing said functions and duties be considered as owner of all of said sewer facilities, but shall in the performance thereof be subject to and act in accordance with the rules, resolutions and ordinances adopted by the Township Committee.
It shall also be the function and duty of the Sewer Utility, and it shall have authority to levy and collect sewer service charges from the owners of and against the properties connected to the sewer facilities in the Township of Harrison, to provide for all necessary administrative managerial and mechanical services and labor and procure all supplies, materials and equipment, purchase all property, both real and personal, and borrow all money required or necessary for the proper and successful operation of the sewer facilities in the Township of Harrison, and also to keep all records, collect all accounts receivable, pay all expenses and accounts payable incident to said operation of said sewer facilities, all in accordance with the rules, resolutions and ordinances adopted by the Township Committee.
The appointment and employment of all employees of the Sewer Utility shall be in accordance with the rules, resolutions and ordinances adopted by the Township Committee.
The business operation and financial affairs of the Sewer Utility shall be administered and managed in accordance with the rules, resolutions and ordinance adopted by the Township Committee.
Any arrangements, working agreements or contracts made by the Sewer Utility with adjoining municipalities for the treatment, transmittal or disposal of sewerage and waste must be first approved by the Township Committee and shall be in accordance with the rules, resolutions and ordinances adopted by the Township Committee.
The Sewer Utility shall at all times function and operate all sewer facilities in the Township of Harrison in accordance with the rules, resolutions and ordinances adopted by the Township Committee of the Township of Harrison, the laws of the State of New Jersey, the rules, regulations and directives of the New Jersey Department of Health, the Department of Environmental Protection and any and all other state departments, bureaus and agencies authorized or empowered to regulate the collection, treatment and disposal of sewerage.
