A.
MUNICIPALITY
Words and phrases. Whenever any words and phrases
are used in this chapter, the meaning respectively ascribed to them
in Subtitle 1 of Title 39 of the Revised Statutes of the State of
New Jersey (N.J.S.A. 39:1-1 et seq.) shall be deemed to apply to such
words and phrases used herein. In addition, as used herein, the following
terms shall have the meanings indicated:
The Township of Harrison, New Jersey.
B.
Official time standard. Whenever certain hours are
named in this chapter, they shall mean either Eastern standard time
or Eastern daylight savings time, as may be in current use.
A.
The Chief of Police of this municipality, or his or
her designee, is hereby authorized to provide by regulation for the
closing of any street or portion thereof to motor vehicle traffic
on any day or days whenever he or she finds that such closing is necessary
for the preservation of the public safety, health or welfare.
B.
Any regulations promulgated by the Chief of Police in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
C.
Any violation of any regulation promulgated thereunder shall be punished as provided in § 214-4 hereof.
D.
Any regulation adopted that mandates the closing of
any street for a period greater than 48 consecutive hours shall not
become effective unless and until it has been submitted to and approved
by the Commissioner of the Department of Transportation.
Any vehicle parked in violation of this chapter
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any peace officer may provide for the removal of such
vehicle. The owner of such vehicle shall bear the reasonable costs
of removal and storage which may result from such removal before regaining
possession of the vehicle.
Unless another penalty is expressly provided
elsewhere in this chapter or by New Jersey statute, every person convicted
of a violation of a provision of this chapter or any supplement thereto
shall be liable to a penalty of not more than $50 or imprisonment
for a term not exceeding 15 days, or both.
If any part or parts of this chapter are, for
any reason, held to be invalid, such decision shall not affect the
validity of the remaining portions of this chapter.
All former traffic ordinances of the municipality
are hereby repealed, and all ordinances or parts of ordinances in
conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.
A.
Adoption of Manual on Uniform Traffic Control Devices
for Streets and Highways. The Township Committee finds and declares
that problems of traffic control occur when traffic must be moved
through or around street construction, maintenance operations and
utility work, above or below the ground, which requires blocking the
street and obstructing the normal flow of traffic, and that such obstructions
are or can become dangerous when not properly controlled. In order
to better promote the public health, safety, peace and welfare, it
is necessary to establish controls and regulations directed to secure
the safe and expeditious movement of traffic through and around construction
and maintenance zones and to provide safety for the work forces performing
these operations. The Township Committee does hereby adopt the current
Manual on Uniform Control Devices for Streets and Highways hereafter
known as the "MUTCD," except as hereby supplemented and amended, as
it controls and regulates whenever construction, maintenance operations
or utility work obstructs the normal flow of traffic. Any person,
contractor or utility who fails to comply with the provisions of the
MUTCD while performing such work is in violation of this section.
B.
Preconstruction meetings. It shall be the responsibility
of the person, contractor or utility wishing to conduct work on, under
or above the street to contact the Chief of Police of the Harrison
Police Department to arrange a preconstruction meeting to submit plans
for the safe movement of traffic during such period of construction
or work. Any person, contractor or utility who fails to comply with
this section prior to the start of such work or whose plans are not
approved by the Chief of Police of the Harrison Township Police Department
is in violation of this section.
C.
Hazardous conditions. The person, contractor or utility
shall provide the Harrison Township Police Department with at least
two emergency contact telephone numbers to be called in case of emergency
problems at the construction or maintenance site prior to the start
of any work. If, for any reason, the emergency contact person cannot
be reached, or if the emergency person does not respond to a call
from the Harrison Township Police Department to correct such hazardous
condition, the Township may respond and correct such hazardous condition(s).
The reasonable fees for such emergency services by the Township shall
be charged to the person, contractor or utility responsible for such
conditions.
D.
Hours. Generally, there shall be no construction,
Township maintenance operations or utility work on any roadway in
the Township before the hour of 7:00 a.m. or after 5:00 p.m. This
time limit may be adjusted to permit work prior to 7:00 a.m. or after
5:00 p.m. by the Chief of Police of the Harrison Police Department,
if reasonable conditions apply and after thoroughly reviewing such
request. However, if it is determined by the officer in charge that
the construction or maintenance operations prior to 7:00 a.m. or after
5:00 p.m. would substantially delay traffic or cause a safety or health
hazard, the work shall then be permitted only between 7:00 a.m. to
5:00 p.m.
E.
Road closings and detours. Road closings and/or traffic
detours shall not be permitted unless approved by the Harrison Township
Police Department.
F.
Traffic directors. Traffic directors shall be posted
at all construction or maintenance sites when determined by the Harrison
Township Police Department that same is necessary to provide for the
safe and expeditious movement of traffic.
G.
Stop work. The Harrison Township Police Department
shall have the authority to stop work, including the removal of equipment
and vehicles, stored material within the street right-of-way, back
filling of open excavations and/or other related work, in order to
abate any nuisance and/or safety hazard or for any violation of this
section.
H.
Site preparation. No materials, vehicles or equipment
are to be placed in the roadway or sidewalk or until all construction,
signs, lights, devices and pavement markings are installed.
I.
Payment for services rendered by traffic directors.
Payment for all traffic directors (certified police officers) working
all construction highway details for directing the appropriate movement
of traffic flow shall be coordinated by the Chief of Police or designee.
The payment shall be the appropriate hourly rate designated by the
Harrison Township Police Department with an additional 15% added to
the subtotal for the use and care of all equipment utilized and all
administrative duties which are required.
J.
Violations and penalties. Any person, contractor or
utility who commits a violation of this section shall, upon conviction
thereof for a first offense, pay a fine of not less than $100 nor
more than $1,000 and/or be imprisoned in the county jail for a term
not exceeding 90 days, or both. For a second offense, upon conviction
thereof, pay a fine of not less than $300 nor more than $1,000 and/or
may be imprisoned in the county jail for a term not exceeding 90 days,
or both. A separate offense shall be deemed committed on each day
during or on which each violation occurs or continues to occur.
The provisions of this chapter imposing a time
limit on parking shall not relieve any person of the duty to observe
other, more restrictive provisions prohibiting or limiting the stopping
or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138,
any other New Jersey Statute or as hereinafter provided.
A.
Upon the declaration of an emergency, there shall
be no parking upon the streets where temporary EMERGENCY NO PARKING
signs are displayed. The Chief of Police or, in his absence, the ranking
police officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
B.
The effectiveness of this section is contingent upon
the signs being erected as required by law.
Whenever snow has fallen and the accumulation
is such that it covers the streets and highways, an emergency shall
exist, and no vehicle shall be parked on the streets or highways or
portions thereof indicated below:

A.
The above parking prohibitions shall remain in effect
after the snow has ceased until the streets have been plowed sufficiently
and to the extent that parking will not interfere with the normal
flow of traffic.
B.
Any unoccupied vehicle parked or standing in violation
of this section shall be deemed a nuisance and a menace to the safe
and proper regulation of traffic, and any police officer may provide
for the removal of such vehicle. The owner shall pay the reasonable
costs of removal and storage which may result from such removal before
regaining possession of the vehicle.

with 40 USC 318B and a written request from the Postmaster, the off-street
locations are hereby designated as handicapped parking, pursuant to
P.L. 1989, c. 201(1), effective June 1, 1990. Such spaces are for

plates or placards by the Division of Motor Vehicles, or a temporary

Signs and pavement markings; installation and maintenance. The owners of the premises referred to in Subsections C, D and G shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual On Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the municipality. The owner shall be responsible for the repair and restoration of same.

Regulation for the movement and the parking of traffic
on municipal property and Board of Education property. In accordance
with the provisions N.J.S.A. 39:4-197, the following municipal and
Board of Education property shall have the movement of traffic controlled
by the type of regulation indicated. No person shall operate or park
a vehicle in violation of the regulations indicated.

General parking.
(a)
All vehicles must park in designated lines and
between the lines provided.

Handicapped parking. All stalls shall be 12
feet wide as shown on the attached site plan[3] and signed with the R7-8 and R7-8P (reserved parking sign
and penalty plate) in the designated parking areas for persons who
have been issued the handicapped parking permit by the Division of
Motor Vehicles.

Reserved parking. All vehicles that are granted specialty
parking in the section, such as police vehicles, ambulances, teachers,
etc., must be properly identified, and the reserved parking spaces
must be shown on the attached site plan.

Tow-away zones. Any vehicle parked or standing as
to obstruct or impede a normal flow of traffic, block entrances or
exits, loading zones, oil fills, grassy area pedestrian walkways,
or present in any way a traffic safety or traffic hazard may be removed
by towing the vehicle at the owner's or operator's expense.

Authorized vehicles only. The following streets or
parts of streets shall be designated as use for authorized vehicles
only. No vehicle other than an authorized vehicle shall enter upon

Restricted areas. No person shall park a vehicle on
streets or parts of streets locate within High Pointe Development
during the hours of 10:00 a.m. through 12:00 noon, Monday through
Friday, from September 1 through June 30 of each year unless a current
parking permit issued by the Harrison Township Police Department is
displayed on the rear view mirror of the said vehicle.
B.
Exemptions. The following motor vehicles shall be
exempt from this ordinance:
(1)
Contractors, service and delivery vehicles. Vehicles
bearing the name and address of a commercial business may park without
a permit on a street during the time the operator or occupants are
rendering services to a resident within the restricted parking area.
(2)
Emergency vehicles and public utility motor vehicles.
Emergency and public utility vehicles may park on a street without
a permit during the time they are rendering services to a resident
within the restricted parking area.
C.
Application. Application for parking permits under
this section shall be made in writing on forms provided by the Harrison
Township Police Department. Permits shall be granted:

Permanent resident permit requirements. To qualify
for the issuance of a permanent resident parking permit, the owner
or operator of a motor vehicle shall be required to have a current
driver's license with driving privileges in the State of New Jersey,
an insurance card and registration certificate for said vehicle as
required by New Jersey statute and present proof of same in making
application for said permit. A permanent resident's parking permit
shall become void upon the occurrence of any of the following events,
at which time the permitee shall be required to turn his or her permanent
resident parking permit into the Harrison Township Police Department:

Signs and permits. The Chief of Police is hereby authorized
and directed to have signs prepared and installed in accordance with
the provisions of this section in compliance with specifications prescribed
by the New Jersey Department of Transportation and the Manual on Uniform
Traffic Control Devices. The Chief of Police is further directed and
authorized to prepare application forms for parking permits and the
permanent resident parking, permanent visitor parking and temporary
visitor parking permits provided for in this section.
F.
Violations and penalties. Every person convicted of
a violation of this section shall be liable to a penalty of not more
than $100 for each offense.
