In accordance with and pursuant to the authority
of P.L. 1988, c. 44 (N.J.S.A. 2c:35-7), the Drug-Free School Zone
Map produced on or about September 26, 1988, by Adam Samiec, the Hillside
Township Engineer, is hereby accepted, approved and adopted as the
official finding and accurate record of the location and areas within
the Township of property which is used for school purposes and which
is owned by or leased to any elementary or secondary school or school
board and of the areas located or situated within 1,000 feet of such
property.
The Drug-Free School Zone Map approved and adopted by the Hillside Township Council pursuant to § 147-1 of this Article shall continually constitute the official finding and accurate record as to the location and boundaries of areas within 1,000 feet of property owned by or leased to any elementary or secondary school or school board which is used for school purposes until such time, if any, that this Article shall be amended to reflect or indicate any additions or deletions with respect to the location and boundaries of school property and drug-free school zones as they pertain to this Article.
The Board of Education, in the case of public
schools, or the superintendent, principal or chief administrative
officer, in the case of any private or parochial educational institution,
is hereby directed and shall be vested with the continuing responsibility
of promptly notifying the Township Engineer and the Township Attorney
of any changes or contemplated changes in the location and boundaries
of any property owned or leased to any elementary or secondary school
or Board of Education and which is used for school purposes.
The Clerk of Hillside Township shall accept for safekeeping and keep on file the original map approved and adopted pursuant to § 147-1 of this Article and provide at a reasonable cost a true copy to any person, agency or court which may request a copy, along with a certification that said copy is a true copy of the approved map accepted or adopted herein and kept on file. It is hereby further directed to provide a true copy of such maps and of this Article, without cost, to the Union County Clerk and to the office of the Union County Prosecutor.
The following matters are hereby resolved, declared
and stated:
A.
It is understood that the map as approved and adopted pursuant to § 147-1 of this Article was prepared and is intended to be used as direct evidence in prosecutions arising under and pursuant to the criminal laws of the State of New Jersey and that, pursuant to state law, such map as approved and adopted shall constitute prima facie evidence of the following:
(1)
The location of elementary and secondary schools within
the Township of Hillside.
(2)
The boundaries of the real property which is owned
by or leased to such schools or the Board of Education.
(3)
That such school property is and continues to be used
for school purposes.
(4)
The location and boundaries of areas which are within
1,000 feet of such school property.
B.
Except as is otherwise expressly noted on the face
of the approved and adopted map, all of the property as depicted on
the approved map herein as school property was owned by or leased
to a school or school board and was being used for school purposes
as of July 9, 1987, that being the effective date of P.L. 1987, c.
101 (N.J.S.A. 2c:35-7).
C.
Pursuant to the provisions of P.L. 1988, c. 44, a
prosecutor is not precluded from introducing or relying upon any other
evidence (direct or circumstantial) or testimony to establish a violation
of the offense defined in that statute, including use of a map or
diagram other than the one approved and adopted herein. The failure
of the map approved herein to show or depict the location and boundaries
of any property which is, in fact, used for school purposes and which
is owned by or leased to any elementary or secondary school or school
board, whether the absence of such depiction is the result of inadvertent
omission or the result of changes in the location and boundaries of
such property that it fails to reflect or where such properties have
not yet been incorporated into a revised approved map, shall not be
deemed to be an official finding and record that such property is
not owned by or leased to a school or board of education or that said
property is not used for school purposes.
D.
All of the requirements set forth in P.L. 1988, c.
44, concerning the preparation, approval and adoption of a Drug-Free
School Map have been complied with.

The purpose of this article is to establish
the Township of Hillside Alliance Against Substance Abuse, whose mission
is to provide consultation, programs, training, and resources to the
Township of Hillside community with the goal of preventing and reducing
the use and abuse of alcohol, tobacco, and other drugs.
A.
There is hereby established in the Township of Hillside
a permanent committee to be known and designated as the "Hillside
Alliance Against Substance Abuse" (hereinafter referred to as "Alliance").
B.
The Alliance shall hold an annual organizational meeting,
shall hold regular open public meetings in accordance with New Jersey
law, shall publish an agenda for each Alliance meeting, shall adopt
bylaws, shall keep minutes of all Alliance meetings, shall permit
public comment at meetings, and shall have a quorum of Alliance members
prior to action being taken by the Alliance at its public meetings.
For the purposes of this article, a quorum is 50% of the official
Alliance membership, plus one.
C.
The Alliance shall operate in accordance and in compliance
with all applicable New Jersey laws governing the conduct of public
entity finance, including, but not limited to, the Local Public Contracts
Law,[1] the Local Budget Law,[2] the Local Fiscal Affairs Law,[3] and all applicable directives issued by the Local Finance
Board.
The membership of the Alliance shall consist
of a committee of nine members, who shall formally meet on a monthly
basis. Members shall be nominated by majority vote of the Township
Council and shall serve for a period of one year. The membership of
the Alliance committee shall include the following:
A.
A representative from the Hillside Township Council.
B.
A representative or an employee of the Hillside Board
of Health.
C.
A member of the Hillside Township Board of Education.
D.
A representative of the Hillside Township Police Department.
E.
Four private citizens who reside in the Township of
Hillside who have an interest or experience in issues concerning alcohol
and/or drug abuse.
F.
A representative of a Township of Hillside civic association.
The responsibilities and powers of the Alliance
committee shall be as follows:
A.
To create a network of community leaders, private
citizens, and representatives from public and private human services
agencies who are dedicated to a comprehensive and coordinated effort
to promote and support drug and alcohol prevention and education programs
and related activities with an emphasis on all ages along the developmental
life processes.
B.
To conduct an assessment of its community to determine
the needs of the community in relation to alcoholism and drug abuse
issues.
C.
To identify existing efforts and services acting to
reduce alcoholism and drug abuse.
D.
To coordinate projects within the municipality to
avoid fragmentation and duplication.
E.
To seek program proposals from the community, or to
develop programs to be implemented at the municipal level, or to participate
in regionally developed programs that accomplish the purpose of the
Alliance effort and the purpose of the Hillside Alliance Committee.
F.
To assist the municipality in acquiring funds for
Alliance programs.
G.
To cooperate with the Governor's Council on Alcoholism
and Drug Abuse, the County Local Advisory Committee on Alcoholism
and Drug Abuse and the Alliance Steering Subcommittee to provide municipal
data, reports or other information which may be required for the County
Annual Municipal Alliance Plan or needed to assist the Alliance effort.
