This chapter is adopted by the Township Committee (now Township Council)
pursuant to the authority granted in N.J.S.A. 40:48-1, Subsection 6, to preserve
public peace and order and prevent riots, disturbances and disorderly assemblages.
Whenever, in the judgment of the Township Council, an emergency exists
or may exist as a result of mob action, riots, disturbances or other civil
disobedience causing danger of injury or damages to persons or property, the
Township shall have the power to impose by proclamation any or all of the
following regulations necessary to preserve the peace and order of the Township:
A.
To impose a curfew upon all or any portion of the Township
thereby requiring all persons in such designated curfew areas to forthwith
remove themselves from the public streets, alleys, parks or other public places
or lands abutting the same, provided that physicians, nurses and ambulance
operators performing medical services, utility personnel maintaining essential
public services, firemen and Township authorized or requested law enforcement
officers and personnel may be exempted from such curfew.
B.
To order the closing of any business establishments anywhere
within the Township for a period of the emergency or impose such other limitations
on business activities or sales as may be necessary.
C.
To designate any public street, thoroughfare or vehicle
parking areas closed to motor vehicles and pedestrian traffic.
D.
To call upon regular and auxiliary law enforcement agencies
and organizations within or without the Township to assist in preserving and
keeping the peace within the Township.
E.
To impose such other rules and regulations as may be
necessary to implement and carry out emergency control operations and to protect
the health, safety and welfare of the citizens and residents of the Township.
The proclamation of emergency provided herein shall become effective
upon its issuance and dissemination to the public. Any emergency and the rules
and regulations proclaimed thereunder shall remain in full force and effect
until amended or terminated by proclamation.
Any person, firm or corporation who shall violate any of the provisions
of this chapter shall, upon conviction, be punishable by a fine not exceeding
$1,000; imprisonment for a term not exceeding 90 days; and/or a period of
community service not exceeding 90 days.
